HC can’t order water release, says Haryana

Weeks after the Delhi High Court directed the Haryana government to release water into the concretised channel (CLC) of the Munak-Haiderpur canal, an affidavit filed by the Haryana government said the High Court does not have the jurisdiction to issue such orders.
Last month, the court had directed Haryana to release 719 cusecs of water into the CLC. However, the state government claimed it was unable to release water as the Delhi Jal Board (DJB) had not connected its pipelines to the Munak CLC.
It also said it has already released 450 cusecs of water for the Haiderpur water treatment plant.
While the government said it was releasing water in compliance with the High Court orders and 1996 Supreme Court directions, it added that the dispute between Delhi and Haryana was an interstate one and was not within the jurisdiction of a High Court.
The government has further claimed that it was supplying enough water for the reservoirs at Haiderpur and Wazirabad, and has raised objections to the DJB’s plan to divert water from the canal to the Dwarka water treatment plant.
The state had raised this objection earlier, after which the court had directed DJB to plug the cut made in the CLC to draw water towards Dwarka.
The state has claimed that the cut has not been closed properly, and has sought directions to DJB to not take any water from the disputed cut till the issue is resolved.
The case was to be heard before the court of Justice B D Ahmed and Justice I S Mehta on Thursday but could not be taken up.
The court will now take up the issue on Friday.

.... but the dispute is within the jurisdiction of Supreme Court which has also ordered for release of water for Delhi.
