Hi DIYbio, I was doing research for a demonstration project I would like to perform when I saw the main author of this academic paper: "

have made a patent application for glowing plants! see: http://www.faqs.org/patents/assignee/bioglow-inc/

What do you think about it? is it morally right or legally possible to patent the use of Lux genes in plants?

I'm not fully sure but is the patent for a transgenic plant containing
the bacterial genes? That seems patentable, right? Its the problem
that Mega and others here were talking about. "How do you get the
bacterial genes expressed in plants?"

AFAIK,
You can patent a specific way how to express the lux genes in plants.

But it hypothetical theory, plants could also develop the genes from itself, or take up DNA from glowing mushrooms (such as panellus stipticus)

It is moraly wrong to patent any genes in any organism. I can't patent adding salt / flavor to the soup. Same thing.

With our broken patent system I'm actually sure you could patent that :-)
