Several months ago, March to be exact, I communicated with you regarding the new City of Houston ordinances relating to the subject properties.  The process is now in place to issue permits under the ordinances and I wanted to share it with you.

All three ordinances require that a person requesting the permit to operate a home, certify that deed restrictions in the area the home is located in have been complied with, although existing Correctional/Alternate housing facilities are exempt from this provision, if they renew their permit by 10/1/19, yes, 2019, that is not a typo.

In addition, any NEW Correctional/Alternate housing facility must be 1000 feet away from a licensed day care facility, public park, recreational facility, school or another Correctional/Alternate housing facility, as well as comply any relevant deed restrictions..

The latest data regarding new permits can be found at https://www.houstonpermittingcenter.org/residentialfacilities under the notifications section. If you review this list and find facilities in your neighborhood that do not comply, complaints should be lodged with:

City Legal Department.  Their hotline for this 832-393-6333 or

City of Houston Legal Department
Neighborhood Services Section
Attn: Deed Restriction Enforcement Team
P.O. Box 368
Houston, TX 77001-0368

I have also attached for your information, an Excel file listing 100 Correctional/Alternate housing facilities in Houston.  If any of these do not obtain a permit from the City by 10/1/19, their exemptions from the grandfathering will expire. In addition, if a facility appears on the new permit list, but not on this list of 100, it should not be able to covered under the grandfathering provisions for existing facilities.

If you find it necessary to submit a complaint to the Legal Department, please keep your neighbors informed and let us know if you are satisfied with the end result.

Regards

Doug Smith
