HOA Problem in Evansville, Indiana

Dear Solar Indiana Partners,

I wanted to make you aware of an ongoing situation with have with an HOA in Evansville, Indiana. 

 

The homeowner interpreted having solar panels on the side (south) of their house as acceptable.  However, the HOA is threatening to sue the homeowner unless he moves them to the back of the house which faces west.  The front of his house faces east and we did NOT put them on the front of the house.

 

The have a Facebook page where they have conducted a poll.  However, I don’t have access to the poll so I can’t see the results. 

 

But, now they are making the home owner garner 200 signatures on a petition, when we don’t think the language of the HOA covenants garner this since it says they can’t be on the ‘front’ of the house.

 

Can we get some legal and/or publicity help?

 

Can we get this in the news so people can see how foolish they are?

 

What do you suggest?

Morton Solar no longer has the resources to fight things like this, and we need all the help with can get.

Brad and Jeffrey:

Where would we sign such a petition?  Jeffrey, are there 200 people in the neighborhood governed by the HOA? Are there 200 homes?  Is this petition  requirement even close to feasible?  

Any lawyers in the group, I this area of law?  From what little reading I've done in the last couple of years it sounds like HOA agreements and requirements are a nightmare legally.

There are over 300 homes in the community. It is a holiday week and knocking on doors most often there is no answer, Only home owners in the community can sign.

Kevin,

Here are the HOA rules. 

 

It says that solar panels can’t be installed on the front of homes (his are not).  But, any solar installations must be reviewed by Developer. 

 

Evidently, they are upset the project didn’t get reviewed.

Yes, but we only got them after the installation. The HOA says that if we had sent it before the instal we would have been told it must go on the back roof. As we know that is not on the CC&Rs.
