Fwd: Update on California Assembly Bill AB5

Good informational update regarding AB5 which goes into effect Jan 1st! The interpreting community wants to be excluded from AB5 along with other professionals such as hairdressers, truck drivers, etc., in order to remain independent contractors. If you agree, see below!

By now, you know Assembly Bill 5 passed the senate. For those among you who would like to take on a more active role in requesting an exemption for interpreters, we would like to share the email that was sent to us by the AIIC (International Association of Conference Interpreters). Feel free to share/forward this update with your interpreter base to facilitate further action.

This is what we know:

1) Other than through a lawsuit, the only way we are going to get our exemption is if we have the blessing of the CAL LABOR FEDERATION.

2) We will not get approval from CAL LABOR FEDERATION without the approval of the nation’s largest public services employees union, AFSCME.

3) CWA has been negotiating with AFSCME to get us some sort of exemption.

4) We were assured by CWA that the bill is so chaotic and impossible to enforce that we will probably not be affected by it when it goes into effect in January.

5) We are going to continue working to get our exemption as soon as the Senate is back in session. CWA has offered to create a committee made up of interpreters to this end.

6) We have been assured by CWA that AFSCME has promised to work with us in January.

7) The fight for exemption has to come from the interpreters, not from the agencies. We've been told repeatedly the authors don't care about the Language Companies/Agencies.

Next immediate steps:

1) Today: write or call Governor Newsom (916) 445-2841 (press 1 for English and then 6 to speak to a representative after a very long pause). Say something like this: Hello, my name is.... I am an interpreter/translator, I am asking Gov. Newsom to veto AB5 because our 5,200 requests for exemption have been ignored by legislators. We are not part of the gig economy, and this bill is discriminatory, it hurts us and it hurts the people for whom we interpreter and translate.

3) As soon as possible: Try to have articles published, get interviews and write blogs about the detrimental effects of AB5.
