[Article 8, Section 3. Amending Judicial Committee Rules of Appellate Procedure]

Problem: There is a question as to the Judicial Committee's ability to amend its rules of appellate procedure. Judicial Committee member terms are now four years, not two years. So, there may be a need during that four-year term to amend the rules of appellate procedure.

Solution: Amend the Bylaws to explicitly authorize the Judicial Committee to amend its rules of appellate procedure more than once a four-year term.

Benefits: Amending the Bylaws to explicitly authorize the Judicial Committee to amend its rules of appellate procedure more than once a four-year term and resolves the question of whether the Judicial Committee already has this authority.


Proposed Amendment

Within 90 days following the regular convention at which elected, the Judicial Committee shall may establish new, or propose amendments to existing, rules of appellate procedure to govern its consideration of matters within the scope of its jurisdiction. The existing Rules shall remain in effect until and unless the Judicial Committee submits new proposed rules to the National Committee for approval, which approval shall be deemed given after 60 days of being submitted unless denied by a 2/3 vote of the National Committee within before 60 days of submission being submitted. If denied, the existing Rules remain in effectThe Judicial Committee may also propose amendments to the rules of appellate procedure from time to time, subject to the same approval procedure. A copy of the current rules of appellate procedure shall be maintained by the Secretary at the Party Headquarters and shall be available to any member at cost.

Co-sponsors welcome.

Also see a need for a separate amendment -- perhaps someone can try their hand at submitting such a proposal for the next meeting's agenda -- to change the last sentence of Art. 8, Sec. 3 to: " A copy of the current rules of appellate procedure shall be maintained by the Secretary at the Party's website." Deleting "Headquarters and shall be available to any member at cost."
