OVERVIEW OF HB25-1169
What the bill proposes
HB25-1169 allows
religious and educational institutions to bypass local zoning and use an administrative
approval process for residential development on land they own. These institutions
already have established pathways for permitting and zoning available to them
and do not need this special privilege. This bill creates a privileged class of
landowners, opening the door to potential abuse and discrimination while undermining
local governments' long-term planning.
CML’S POSITION:
CML Opposes HB25-1169
CML believes that
HB25-1169 is
the most aggressive legislation of its kind in the nation and creates a privileged
class of landowners. The proposal lacks any demonstrated need or evidence of issues
with the existing rezoning and permitting processes.
