I am opposed to item 11 in the proposed Land Development Code update. Please vote to remove it from your "not opposed" list of proposals.
The City Noise Ordinance should not be bypassed in this way. Commercial enterprises that make money at the expense of the health and wellbeing of City residents should not be encouraged to do so by allowing the City Manager to approve their behavior. The proposed amendment takes away all the guardrails to intrusive noise and turns the City into a free-for-all for profit-making noise-makers. It effectively guts the Noise Ordinance, which is already difficult to get enforced.
If it is not withdrawn from consideration by the City Council, then this amendment should go through a CEQA review to be fully vetted for compliance with the law. Noise pollution is a defined part of environmental quality, and it's likely that there will be a significant impact on the environment from any entity given a special events permit by the City Manager. If the amendment does not undergo a CEQA review, then every special events permit should be required to do so to assure compliance with that Act.
