Commissioner Kefalas,

I wanted to follow up about the property up in Laporte owned by Nicole and Chad Uthmann, where they are operating a sawmill without County approvals. Chad Gray and I met with the Uthmanns last week, along with some NRCS representatives (including Zach Thode). It was a productive conversation, and we all agreed that it would be appropriate to extend the deadline for them to start the rezoning process. They appear to be on track to submit a rezoning application by the new January 31 deadline.

During today's visit to file the rezoning application, Chad was informed that the procedure he followed was incorrect. I provided Chad with a printed copy of the email, but his lack of familiarity with the internet and your email led him to believe that a simple one-page application/fee was all that was necessary. His understanding was that the county would assist and navigate the submittal requirements with him after receiving the application and the fee, given the complexity of the information requested. 


Managing multiple businesses while navigating the complexities of zoning application procedures can be overwhelming and confusing. I apologize sincerely for misunderstanding.

This is a friendly reminder that there is a deadline of December 8, 2023 to submit an application to rezone your property at 2318 County Road 54G or cease sawmill operations and remove the associated materials stored on the property.

I've attached a slightly revised Inquiry Report.  The report now refers to the Planned Development zoning district instead of the Rural Planned Development and it updated a link to the Land Use Code.  These changes are not substantial and do not change any of the submittal requirements.

If you'd like to include an appeal to the rezoning review fee, you can include the request in the rezoning project description.  The request should address the following criteria:

1. The development as proposed helps achieve a density or intensity reduction of existing uses consistent with adopted plans (in this case, the LaPorte Area Plan).

2. Staff has made an error in processing the project application.

3. An exceptional, documented financial hardship exists (please provide documentation of the hardship).

4. The development application is from a jurisdiction or department with a current Intergovernmental Agreement or Memo of understanding which addresses application fees (none currently exist)

Please note that you will be required to pay the full application fee when the rezoning application is submitted.  The public hearing on the fee appeal will occur on the same day as the Board of County Commissioners public hearing on the rezoning request.  If the BCC approves a reduction or elimination of the fee, the applicable amount will be refunded.

Hi Commissioner,

Yes, I will be online at LAPAC tonight. It sounds like all of the committee members will be online, but Laura will be in the Hearing Room in case any members of the public want to attend in-person. And you are correct, you should not be present for the discussion about the development proposal.
