Dear Commissioner Kefalas and Commissioner Steven’s,
I rarely bring issues up to you, but what I just received below is what is fundamentally wrong with the Development Process. I was notified this morning that the County is issuing a Stop Work order for our Bloom Project. For 3 years we worked with the City of Fort Collins and Larimer County on what would be the appropriate process, review agency, controlling plan set, and inspection responsibilities for the coordination of improvements that straddle multiple property owners and governmental entities. Our situation is one of the more complex jurisdictional control issues in the region and a go forward to plan to construct the improvements was well thought-out. It turns out that a small handful of improvements that were always planned to be constructed lie outside the boundaries of the roadway that the City Annexed. As such, we are no longer allowed to construct those issues until we get yet another permit from the County and post security. This seems crazy given the nature of the improvements in this scenario.
My biggest concern with the correspondence is that instead of a phone call to notify us of the issue and meeting to talk about concerns, the County went straight to a stop work order. This essentially brings a large housing project in Fort Collins to a griding halt. The County maybe well within its rights to do this, but the scope of these improvements is so inconsequential that this request seems like they are just trying to halt the project for bureaucratic reasons.
The last item in the email notice relates to work in the floodplain. This issue is squarely on us as our contractor thought they were staying out of the area they weren’t supposed to work in but did not. We will be addressing this with them and will stand down until the appropriate permits are in hand.
Im sorry to write this, but I just felt problems are better solved with discussion and communication as opposed to demands.

Subject: Grading outside of City Limits on Peakview Property (STOP WORK)
All,
Our MS4 and ROW inspection team notified me this morning that grading was being completed outside of the annexed ROW on the Peakview property. No work was to take place on the unincorporated parcels until they were either annexed into Fort Collins or construction collateral was provided in full to the County and a Development Construction Permit was issued.
I was also made aware that work within the Floodplain was being completed without an issued floodplain development permit. All work within unincorporated Larimer County is to cease immediately until the requirements of the Peakview Development Agreement have been met or the properties have been annexed into the City.
Additionally, no work is to take place within the regulatory floodplain until the DA requirements have been met and a floodplain development permit has been issued.
We need to discuss temporary erosion control measures and a reestablishment plan immediately.
