Three amendments to SB 131 are attached. Two are finalized, one is a draft:

  • L.001 is the exception for peace officers (law enforcement officers).
  • L.003 makes a violation a "secondary offense" by requiring an officer to have contacted the person about a separate violation before citing the person for a sensitive spaces violation. This is modeled on the seat belt law.
  • L.002 is the remaining amendments. This is drafted as separate amendments in a single document, so the different sections have a heading explaining the content (and since they are drafted as if they are individual amendments, you'll see some duplication. That will be resolved based on how they are grouped together). This is not too much over a page, but some pieces would need to be removed into a new amendment to get it on one page. Please let me know how you would like these grouped. Of course, these could all be separate amendments if you want.


Please let me know if you have any questions and how you would like to separate the amendments in L.002.

Conrad,

I have the following amendment requests.  They should be done separately or in small groups to avoid a 2 page amendment.  

1.  For hunting and target shooting on state parks and lands. We discussed this one and you may write it however you need to make sure that hunting and target shooting is allowed on CPW or SLB buildings or real property.  
 This prohibition does not apply to the use of weapons permitted by law or regulation to be used for hunting [or target shooting on CPW or SLB buildings or real property open to hunting or target shooting]. [Cal. Code Regs. tit. 14, § 4313(b).] Firearms that do not have a cartridge in any portion of the mechanism, or other unloaded weapons, may be possessed within [CO state land location where firearms are stored] when such weapons are rendered temporarily inoperable or are packed, cased, or stored in a manner that will prevent their ready use. [Cal. Code Regs. tit. 14, § 4313(c).]

2.  Language for the Catholic Church:  
Strike “operating authority” on page 4, line 7, and replace with “church, synagogue, mosque, temple, or other place of worship”:
(g) A PROPERTY OR FACILITY OWNED OR OPERATED BY A CHURCH, SYNAGOGUE, MOSQUE, TEMPLE, OR OTHER PLACE OF WORSHIP WITHOUT EXPRESS PERMISSION FROM THE OPERATING AUTHORITY CHURCH, SYNAGOGUE, MOSQUE, TEMPLE, OR OTHER PLACE OF WORSHIP;

3.  P.5 line 17 add LICENSED before day care.  

4.  We need to add an exemption in courts/courthouses for when firearms are used as evidence, see the ghost gun law.  

5.  Page 6 section (d) Please add this language for storage in vehicles in parking lots.  “IN A LOCKED CONTAINER IN A LOCKED VEHICLE.  THE LOCKED CONTAINER MUST NOT BE VISIBLE FROM THE EXTERIOR OF THE VEHICLE AND MUST BE SOTRED IN A LOCKED GLOVE COMPARTMENT OR LOCKED TRUNK”.  

6. P 3 STRIKE LINES 6-9.  We are taking out rec center because we believe they fall under the local government buildings and guidelines under (m) of this section.
