A Foreign and Comparative International Law Webinar: Two Sides of the Same Coin: The Evolution of Surrogacy Law in France and Colombia

We hope you will join foreign law specialist Louis Gilbert and Stephania Alvarez for the next entry in the series for the Foreign and Comparative International Law webinars hosted by the Law Library of Congress. In this entry, Law Library's foreign law specialists will explore the contrasting surrogacy laws in France and Colombia. In France, surrogacy is prohibited; however, the law allows for the recognition of filiation for children born through surrogacy abroad. In contrast, Colombia has no explicit legislation on surrogacy, but the Constitutional Court has deemed it constitutional, permitting legal contracts with surrogates under specific rules. Additionally, Colombia provides mechanisms for automatically severing the surrogate mother's filiation. The discussion will focus on how these opposing legal frameworks interact, enabling European Union and French citizens to pursue surrogacy arrangements in certain countries, such as Colombia.
