It's not just a nuisance when motor vehicles are parked in bike lanes. Today we read of this utterly avoidable tragedy:

"A 3-year-old girl out riding with her mother in Uptown was killed Thursday when the woman tried squeezing around a ComEd truck illegally parked in a bike lane and was hit by a passing semi." More here:


Bike lanes must be kept free of all obstacles. Parked vehicles should be towed as well as cited. (Simply ticketing them will not deter corporate abusers.) Inaction will lead to a similar tragedy here one day.

it had to be 5 or 6 that were blocking bike lanes today.
one guys excuse was that he was throwing trash away (aka illegally dumping in someone else's dumpster.)

are there any places to report chronic abuses / request red cubs being painted?

This is heart-breaking.  I'm originally from Chicago, and I know they're trying to roll out bike infrastructure.  I'm constantly having to get out of the bike line to avoid huge piles of landscaping debris on both sides of Santa Teresa between Bailey Ave and Blossom Hill rd in San Jose.  I do worry about getting clipped some day.

I was biking home after the last San Jose Viva Calle (Oct?) and I was wondering how all you san jose folks dealt with having to dodge the piles of greenery dumped in the bike lane every single week.

From your response, it appears that you don't have an easy time of it.

As far as reporting waste, or organics in a bicycle lane, the SJDOT advised me that wasteenf...@sanjoseca.gov is the correct email to report those type of obstructions.

Matthew, I occasionally ride around that area too and it is always a problem with that particular business's vehicles. There are a couple of bike lanes I frequent in the city that are riddled with the same issues:

  1. Berryessa Road at Commercial Street
    1. There are big 18 wheelers and haulers parked in the bike lane literally every day, blocking both the bike lane and the fire hydrants along the road. Mostly its clients of the diesel repair business at that intersection, frequently doing repairs on their trucks in the bike lane.
      1. I have reached out to the city requesting the curbs in front of the fire hydrants be painted red (they aren't presently), and that they increase parking compliance patrols. They said they would send an engineer out to investigate the curbs.
  2. E San Salvadore at SJSU, especially between 7th and 10th
    1. Students, parents, etc. constantly use the bike lane as a drop-off zone so what should be a pleasant bike lane is frequently barely usable by bikes at all.
      1. I reached out to the city about this as well, and they at least doubled-up on the bollards lining the bike lane in addition to increasing parking compliance patrols. There has not really been a noticeable difference- honestly we probably need concrete here to make a real impact.
    2. SJSU bus drivers constantly park in the bike lane on San Salvadore.
      1. I have also reached out to the city about this one too- they said they are beginning construction on a concrete bus island sometime between now and August.

So it sounds like bike lanes being used for many things other than cycling around town, and it is a pervasive issue requiring a cultural shift toward respecting bike lanes as places for bikes. Matthew, I would be happy to work with you toward addressing this with the city if there is anything I can offer.

Can’t agreed more Geoffrey. I have seen the same on the exact routes and bicycle lanes you mentioned. In the past two weeks I have emailed them 20 times regarding parking, garbage and other objects in the protected bicycle lanes.  It does feel like a better design (cement bollards even at the entrances) would do the trick. I also tag them on Twitter in conjunction with the emails which both include a video.

Thank you everyone for your support in this effort to ensure that bike lanes are reserved for cyclists. As it obvious to us, the city can hardly expect to get people out of motorized vehicles  if it doesn't offer a safe alternative.

It's clear that there are numerous issues with obstacles in the bike lanes, necessitating a multi-pronged solution addressing (a) parked personal cars, (b) workers (gardeners, painters, plumbers) parking while on a job, (c) delivery vehicles on a tight schedule who can't be bothered even pulling up to the curb, say nothing of parking around the corner or in an adjacent lot, and who aren't deterred by the threat of a citation, (d) garbage bins, and (e) garden waste.

I just had a call from Russel Joyce who works in Environmental Services Department for the City, dealing with waste enforcement. 
Russel has commuted by bike for many years and understands the issues and dangers involved in biking in the city.  He will be meeting with some managers (where he will bring up our concerns) and will reply to the email within a week.
A couple of things he mentioned that might help to understand the situation better.
Carts that are placed out, outside of the allowable window, will be dealt with (inside the window is a different problem).
Blocking of the bike lane (when it is adjacent to a vehicle traffic lane where bikes are allowed) is OK, in the window) as bikes have an alternative path (vehicle lane).  And the reverse of that, blocking the vehicle lane, is never allowed because the vehicles don’t have an alternative path.
There is a thing called Push/Pull service where the haulers will go onto the resident’s property to get, empty, and put back their carts; that cost $50 per month.

I will let Russel explain the rest of it when he responds, but just wanted to clarify those few things to help understand the complexity of the issues/solutions.

I don't understand why blocking the bikelane would be acceptable during the pick up window if the debris can be place in the parking area? If there is no alternative, I sort of understand.

The consequences are much bigger for cyclists. Reduced parking spaces vs risking a cyclists' life because they have to swerve into the vehicle traffic lanes?

I probably wasn’t clear enough about that, it is only allowed during the window (part of the day before, and the day of pick-up), when the bike lane is curb adjacent, like this:

And Russel is aware of the situation here; After the carts are emptied, they are left further out in the roadway.

But this leads into two things I forgot to mention:
This whole problem (Waste/Recycling collection and Bike Infrastructure) exists because the two programs were implemented independently of each other, and without concern for the other.

And I asked Russel to consider if there is anything our group (or subgroup) could do to help facilitate a resolution or at least to mitigate the danger aspect.  From what I have recorded the problem is much larger than it needs to be (more than 50% of the specific problems might already have a solution that is not difficult to implement).  And what I was thinking is that maybe a reporting method could be implemented for trusted sources (Us) where all the necessary info is gathered and turned over, in a consistent way, to the correct city department.  The purpose being to unburden the city with the part of making a trip to the problem area just to see that there is actually a problem.  Not sure if that will help but it is all I have I come up with.  And the other aspect is monitoring for effectiveness, as that part is not easy at all for the city to do, and for the city to communicate with residents can be problematic too (i.e., apartment buildings, or other rental situations).

Thank you Matthew, that makes a lot of sense.

Levi's stadium also regularly puts event signs smack dab in the middle of the bike lane, days before the actual event (see images below). I have had multiple conversations with the city of Santa Clara on this. But Levi's seems to have new contractors all the time and they relapse frequently. And since the stadium is bordeline san jose, sometime they do the same for signs on SJ territory.  Dangerous, against city guidelines and with a perfect existing alternative (put it in the buffer zone and give cyclist 3 feet to pass to the right of the sign or put it to the right of the sidewalk)

To add to this, I was on a group ride recently when one of the riders
plowed into a dark brown garbage bin on Beswick Drive around 9pm at
night. The can was empty, so my guess is that the owner had been
negligent in bringing it in. People keep complaining that bicycle
riders sometimes wear dark colors. Maybe we should require reflectors
on garbage cans, but I digress. I would be interested in knowing how
we could report such issues.

Another incident occurred on Park Ave, where dark and low piles of
garden waste frequently litter the bike lane all week. I believe
those were reported to the city, but I'm not sure what actions were
taken.

While on this topic, does anyone think we can do anything about the
Hyatt Place operating its valet parking in the bicycle lane on
Alameden Blvd? Despite numerous complaints to the city, it's been
there so long that you can plainly see the "Valet Only" sign right
smack in the middle of the bicycle lane on Google Street View.

Random thought on this topic:

Make spray paint stencils for "don't block the bike lane with equipment" and give them to companies that rent portable signs like this. i.e. A Tool Shed, United Rentals, Sunbelt, Dahl's, Cresco, etc. Useful for more than just these portable signs.

Also ask sign makers if they could make skinnier signs so they fit better between the bike lane and car lane. i.e. the width of a single car so they "fit" in a parking spot with ease; pictured ones are bigger. Sample size one: https://www.trans-supply.com/pg/341/full-matrix-message-board?ProductID=176 width is 133" (11 ft 1 in) i.e. lane width compared to https://ops.fhwa.dot.gov docs which say 102" max vehicle width; i.e. 31" narrower. And ask the rental centers to carry them and mark them as such "for use in a car lane" and "for use in a car parking spot".

That Hyatt situation has been reported so many times, police doesn't bloody care or is paid to look the other way. A friend of mine passes there every day and crashed there once because of the valet parking in the bike lane. That is a big corporation, let's go after them!

I have submitted a couple weeks worth of video documentation of both refuse/trash/bins and vehicles parked in the bicycles lanes that I have traveled within to the city and I did receive an official response.  I'm passing this on as an FYI if it can help any of you through the process.  Thank you.

Thanks for your patience while we got this information together.

Please find resources and information below that might help mitigate some of your concerns.
I've also been asked to share the following information:
  • San Jose's DOT's Active Transportation Program (ATP), which designs and builds bikeways, is continually seeking design improvements to reduce the issues you've brought to light.  
    • Two of the many challenges are: 
      • (1)  separated bikeways must be at least 7' wide to allow our bikeway-specific sweeper to fit in the bikeway (narrow cars can sneak in that area and block the bikeway); and 
      • (2) some streets have such high parking demand and narrow sidewalks that there is no space to place trash/recycling/yard waste without blocking driveways, sidewalks, parking, bikeways or vehicle travel lanes.
You can also send general bikeway questions or comments to ryan....@sanjoseca.gov.  Ryan manages San Jose DOT's ATP group mentioned above; and (2) you can attend San Joe's Bicycle Pedestrian Advisory Committee meetings, which are open to the public.

Good job, Buki! We seem to have a "cohort" of people who are very passionate about the blocked bike lanes - great! 

I suggest adding this to the agenda of our next week's meeting - this should definitely be on our SJ Team "work plan".

Another full confessional, I do not like their answers. 

Cars do not “sneak” in, they basically allow full FedEx vans in and out with ease and for a once a month sweeper? That’s poor design.  

Also the narrow streets mentioned regarding the trash bins/refuse I have recorded  videos on are over 80 feet wide, that’s not narrow and it’s again, poor design and departments not talking to each other. 

But definitely something to talk about next meeting.  Image.jpeg
