The MD law does not prohibit spamming. Indeed, the consent of the
recipient is not addressed in the law at all. The law in question
prohibits certain kinds of header forgery or deceptive subject
lines in commercial email,
nothing more.
However, many spammers do forge their headers or use deceptive
subject lines in violation of the aformentioned law.
