based upon religion or nationality which are a choice (perhaps to a
lesser extent in respect of the latter) exercised by the actor in
question.
It is a common misconception to confuse religious or nationalist
discrimination with racial discrimination. However, whether you
believe one to be more insidious than the other is of course a choice
for you. Certainly, the law recognises religion or nationality as
being quite distinct from race, given several cases which have been
brought under Employment Legislation where a claimant has alleged
racial discrimination within the workplace based upon their being put
at a disadvantage because of their religion. Most notably, the
instance of a Sikh man sacked for refusing to remove his Turban in an
occupation where it was a hindrance. The court held that the dismissal
was fair and perfectly legal, given that the Race Discrimination Act
proscribed only discrimination based on race. The man's treatment was
based upon his _religion_ and not his race.
Again, the rationale for this was based upon transience. The Asian man
_could_ have removed his Turban. It is often believed that it is worse
to cause another to suffer disadvantage or harassment because of
something over which they have no control. For example, one may be
quite happy to call an overweight man scoffing burgers a 'fat
bastard'. However, one may suddenly feel intense guilt if it
transpired that the man in question has, for example, a thyroid
disorder, and cannot help being obese.
Interestingly enough (given the discussion you and Neville are having
regarding Jewishness - interspersed by some actually rather accurate
ranting from PV, spoiled, of course, by his insane delivery) in the
Sikh case noted above, the claimant relied upon a previous case in
which a man dismissed due to his Jewish faith had his claim upheld.
The Tribunal distinguished this case on the basis that to be Jewish
was both a religion _and_ a race. The case turned on some technicality
which states that one is born a Jew and cannot become a true Jew by
conversion. I can't remember the details, but if you are interested, I
could try to dig it out.
Anyway, I digress. Regardless of discussion regarding the Jewish
faith, there is no way of arguing that Americans are a race. I could
therefore quite easily claim that 'all Yanks are fat, arrogant, thick,

I'm not sure I agree. Whilst the word 'racism' is _prima facie_
reserved for actions discriminating against a person based on his
ethnic origin (cf. 'race'), _Fowler's_ allows for the use of the term
to denote discrimination based on 'colour, religion or nationality'.
As persons of different races can (and often do) share common bonds in
religion or nationality, I believe that the term 'racism' (or its
'ancestor' which I still prefer, 'racialism') is satisfactory in this
context.
This one was played out quite extensively on news:rec.travel.europe
just before the United States' criminal war of aggression against the
Iraqi people. The immature attacks by dumbfuck 'Americans' (sic) like
SFB and Drewl-Boy, were defended by equally dumbfuck 'Americans' (sic)

'True' (sic) Jewishness is passed from mother to child, and there is
certainly a school of Orthodox Jewry that considers the proselyte as
somehow 'less Jewish' than the Jew born into the religion. The Talmud
is clear in its condemnation of such discrimination, but as the
Orthodox Jews have enough influence in Israel at the moment, the law
there limits official conversions to those carried out by Orthodox
rabbis.

Well done, Neville, you have spotted the 'deliberate mistake' as I
probed to see if anyone in the group would notice if I meandered off
into talking complete bollocks during a session of legal showboating.
Of course, I got the facts of the case in question (Tejani v
Peterborough Superintendant Registraar) arse about tit. In fact, the
Sikh's claim was upheld as Sikhs were classed as being an 'ethnic
origin', rather than a religion (the latter not being covered by the
scope of the Act).
You are indeed quite correct. Because the Sikh or Jewish identity is
defined by more than religion alone, they constitute an ethnic group.
How this fitted into my point to John was that racism is a very narrow
category of discrimination. The Act proscribes discrimination based
upon colour, race, nationality or ethnic origin
All four categories are quite distinct, and to bring a claim, one must
decide which type of discrimination one alleges. Clearly, a man sacked
because he was born in America would claim unfair dismissal based upon
discrimination as to national origin, not race.
In stating that we 'endure' the Act, you seem to imply disapproval. Do
you believe that a person who follows rastafarianism should be
protected from dismissal for smoking skunk at work? Do you think that

origin' or 'colour'. A person has the choice in England of being a
Muslim or not being a Muslim. It is 'only' a religion.

proscribes discrimination based upon 'ethnic origin', which covers

Again, I don't know. It could be a load of bollocks, it could be an
anomaly based upon the precedent classifying Jews as a race. Get me
the case name and I'll look for it. While we're at it, neither do I
know why the law sees fit to outlaw discrimination based upon
nationality but not religion - both characteristics being (in theory)
within the actors control.

Again... cajun voodoo rubbish. There are many variations on the
definition of _race_, and much depends upon how one uses it. Do
you believe Italian is a _race_? Quite readily, according to the
definition it could well be. Since Italians are connected by a
common descent or origin. Certainly one from a long line of ethnic
Italians unbroken for many years can easily be seen as different
from one coming from a long line of ethnic Norwegians unbroken
for many years. Even more easily seen as different than might be
a dark-skinned Latin, and a light-skinned Black.
While, of course, most make the distinction that you do, that there
are only a very limited number of races, which must conform to the
various labels that are attached to skin colors, and must be readily
physically distinguishable by such skin color, because it is easier.
Such grouping are usually done more as a matter of expediency,
so data can be assembled through having a smaller number of
types of races to deal with in even primitive older use of statistical
analysis. Rather than needing a more unwieldy class for every ethnic
stock.
Believe it or not, some feel there is an undercurrent of racism to
the use of such methods, since the idea of race is rather artificial
in respect to our species. I don't agree with that, but I simply
mention that some do. Some refuse on principle to enter "race"
when on a questionnaire form. I understand that when the
taxonomy linage of the animal kingdom was first developed,
some wanted to break down Genus = Homo, and
Species = Sapiens even further into the various races by skin
color. This was almost immediately recognized, even so long
ago, as implied racism. Although the identification of various
races by sight, in certain senses is rather obvious. As it is
obvious that it serves various purposes, quite distinct from
racism, having a practical use of identification.
Whether ethnic can mean the race of a person, depends a lot on
how one wishes to define it, and not much more. Since there is,
of course, the most broad application -- the human race. In
fact, the words _ethnic_ and _race_ have so many similarities
that the definitions rather overlap in some parts of those
definitions... with _ethnic_ even defined as "pertaining to race"
in part of the definition in the OED, and _race_ even defined
as "A group of several tribes or peoples, regarded as forming
a distinct ethnical stock," in part of that definition in the OED.

If you are speaking of Native Americans, it is quite easy to
do so. However, given the fact that non-Native Americans
have immigrated to the U.S. in such a short time span, their
ethnic origins have not been sufficiently diluted to have
disappeared. American is an admitted nation of immigrants,
with probably 95% able to trace their roots to another
nation, and the other 5% ready to tell you to go to hell,
'cause they just don't care.

on me. As I said it before, if criticizing the US means being an
anti-American, then, yes, I am an anti-American. At times, I'm also an

Each one who uses should be able to give a definition.
I notice, however, that this label is being put on all those who criticize

though their comments or criticisms had no racist feature.
Putting such labels, while being a convenient way to prevent any criticism
from being expressed, is actually dangerous as it ends up trivializing
racism. By calling everything racism, one loses the possibility to use this
word when it is accurate.

Do Liverpudlians constitute an 'ethnic group'? Could one bring case if

No.
I should think it would be very difficult to show discrimination: most
people would get their cards for turning up smashed on booze [1], let
alone partaking of anything currently prohibited; many are forbidden
to even smoke _cigerettes_ whilst 'on duty'.
That said (and here I go slighly off-topic) I do find it odd that a
Sikh is exempt from wearing a crash-helmet, an act that could have
very serious consequences indeed, and yet a Rastafarian is not allowed
to smoke dope (which is, after all, a harmless enough activity).
My position is that no dispensation should be given on account of
religion.

In which: "Finally, according to "Mandla" a person can fall into a
