at Audiogon), has been confirmed by Sennheiser USA as NOT a dealer.
Sennheiser has issued a strong warning with regards to illegitimate,
counterfeit products (a problem plaguing several microphone and headphone
companies from mainland Chinese counterfeiters). The scam is being run by :

I do know that no "investigation" of Sound Emporium has been conducted.
What McCarty may have done is called up the EarMax and been told that they
are not an authorized dealer.
In the peculiar world of high-end stereo, this doesn't actually mean that.
For example, EarMax could be shipping the stuff to Sound Emporium without
admitting, so as not to annoy their "authorized dealers."
In the the world of hi-fi, anything is possible, because the name of the
game for the manufacturer is to move the product. This also includes grey
market, which exists because dealers who are forced by quota to buy more
than they can sell unload it to other dealers.

Thus it is a far stretch from "discovering" that someone is not an
authorized dealer to assuming that product is counterfeit.

McCarty attacks these people not because he has anything to offer, but
because in his sickness, he can be satisfied only by punishing others.
As is well known to members of this group, he is a scammer on a gigantic
level beyond anything ever seen on this group.

are buzzing nests of lies and deceit.

I agree that he has the potential to be a rapist. Whether he has ever
committed rape, I do not know.

FWIW, I have a photograph (digital) somewhere that Bwyan's old (now deceased)
friend Zippy sent me before he died. He in no way resembles the guy on that
Illinois website. First of all, the guy on that site is WAY, WAY less fat
than the Brian in question. Apart from this Australian fiasco, some folks
have also claimed that he lives (lived?) in the LA area as an out of work
union boom mike operator or some such drivel.

Regardless of the truth of the matter, he's a troll. He's unlikely to
ever have a real relationship with an actual living, breathing human
being, so he takes it out on whoever he can get a rise out of on Usenet.

FYI, the link in question, to the Illinois Department of Corrections, has
never, to my knowledge, been posted by anyone except McCarty himself, to
ridicule his detractors, and by McCarty forging my name.

I am also in possession of the picture which you mention.
It's been pointed out both that the picture appears to have been doctored,
and also, that McCarty nevertheless resembles the picture.

We have a recording of McCarty's voice. It is an unpleasant, whiny, voice
that fits the image of his personality.
McCarty is personally quite timid. When he makes harassing phone calls, he
hangs up if a man answers the phone; if a woman answers, he harasses her.

It appears that McCarty is terrified of traceability in any form. Recently,
he sent us a document, but did not sign it, preferring instead to use a
large typeface where the signature would normally appear.

Here are some miscellaneous facts about McCarty:
McCarty is or was a member of IATSE Local 700 in LA.
He has worked both as a boom mike operator and a mix board operator.
He formed a company called "WorldJazz", an early concept for internet radio,
and sold it at the height of the bubble for a considerable sum of cash.
He developed an interest in the Far East, and has traveled there
extensively, including many trips to Mainland China.

He has a talent for selectively targeting individuals, and like a spider,
sucking them into his embrace. Among his victims were Jeff Wexler, son of
the noted cinematographer Haskell Wexler, and the brother of the P.M. of
Australia.
McCarty attempted to develop a sound studio in Cairns, Australia.
The major backers withdrew, possibly sensing that McCarty has a mental
imbalance. This could be the result of McCarty's interaction with the late
Steve Zipser on this group, which was most unseemly.
The studio collapse involved the brother of the P.M., and threatened to
become an election issue.
Possibly as a result of this incident, McCarty became unfocused on his work,
and began to "act out" against strangers on this newsgroup.
McCarty has a strange attraction toward the use of false identities on
usenet, and uses many of them, even when there is no apparent advantage to
doing so.
His Coral Sea Studios website is a ridiculous collection of false
endorsements, and even has a nonexistent front man "Feng".

We had McCarty analyzed by a Ph.D. psychologist, with the conclusion that
McCarty is probably internally motivated. This means he will not go away if
ignored. However, this expert did suggest that peer pressure might have an
effect.

I have observed that McCarty's misbehavior goes through cycles, as if he
suffers from a bipolar disorder. Currently, McCarty's activity on this group
is at an elevated level, but in a week or two, as his brain changes
chemically, it will decline. In my opinion, it's important to negate his
lies, because it drains his mental energy and keeps him weak.

McCarty is currently torturing a company by the name of Sound Emporium.
He accuses them of selling counterfeit Sennheiser headphones and also, of
not being an authorized Earmax dealer.

I have today communicated with both the V.P. of Marketing at Sennheiser at
Old Lyme, Connecticut (telephone), and the principal of Earmax, H. Huschens,
in the U.K. (email.)

Sound Emporium is indeed a dealer in good standing with Earmax.

The V.P. at Sennheiser explained that while they distribute directly to the
larger chains, every other reseller is serviced through two distributors,
who are free to sell to anyone. The distributors are supposed to sell only
to resellers, but Sennheiser does not actually check for compliance. With
regard to McCarty's statement

"Same thing "Sound Emporium" said about their Sennheiser scam. . . .which

Sennheiser rebutted in three words, "lying fucking scamsters".",
the V.P. denied the possibility that they would make a statement in this
language.

In other words, anyone, any of us, is free to buy Sennheiser headphones in
bulk for purpose of resale. It is key to Senneheiser's strategy of making
their headphones available in the many smaller record stores and specialty
shops that purchase only small quantities.

Since the Sennheiser distribution scheme does not rely on authorized
dealers, McCarty's point is moot.

McCarty asserts that the headphones are counterfeit. The Sennheiser V.P.
stated that their audiophile headphones have never been subject to
counterfeiting, noting that some items intended for usage with computers,
such as microphones for dictation, have been subject to something akin to
this.

We discussed the issue of grey market products, ie., products which are sold
by a German distributor directly to a reseller in the U.S. Several years
ago, when the dollar was stronger, there was a signficant financial
incentive for this to occur. Sennheiser explained that this is an internal
issue between the various branches of Sennheiser, and that no penalty is
incurred by a U.S. buyer OR seller of a grey market headphone. The warranty
is honored in all cases, because Sennheiser puts the customer first.

It appears that Sound Emporium is in every regard a legitimate dealer, who
is suffering material harm, that may significant, by McCarty's actions.

Reproduced below is the message of this thread in which McCarty makes his
accusations.

All of his accusations have been determined to be baseless, by direct
communication with officers of the two companies involved, Sennheiser USA,
and Earmax.

Stan Howard's new pay battle

specifically including grey market products. Wherever you buy it, as long as
