Queens User group scam or Tom Morris <tcastellanos@earthlink.net> =Scammer

A while back I had placed an ad here for WTB Amiga LIVE! card. Tom Morris
had sent me a message and after some technical discussions, we decided that
I would purchase the card as well as an Amiga2000 from him. I sent him a
postal money order on March 23, 2002, and have not received any product.

I have notified the US Postal Inspectors regarding this, as well as his ISP.

His signature mentions the Queens User Group, although I do not believe that
they perpetrated or had any involvement with this scam. His sig also makes
note of Magnetic Media Productions:

Hi,

I've sold stuff to Tom (aka magnetic on Ebay..or something like that).
It took a bit before I got paid, but overall the transaction went
well. He has a pretty good rating on Ebay as well and does seem like
a busy fellow. Scammed may be a bit of a harsh description until you
get the issue resolved. Good luck in your endeavour.

I too have bought items from Tom and though he has been a little
slow I've gotten my items. A while back I bought a Cyberstorm
MkII/060 from him and the board arrived in good shape and has worked
fine in my A3000 since then.

Well, i am putting together a list of his less than satified customers.
All reports are that he takes forever. In my case, we are going on one
year. I know of people with longer standing issues.

It is my current plan to take him to small claims court, as soon as I can
get out to NY to file. If possible (I am still unclear if this can be done
in small claims) I will file on behalf of the others I have contacted.

But my advise is, write him email every day, a couple times a day, and he
seems to finally come through. Just didn't work for me.

Small claims court is also where I am heading in this. I have a friend in
NYC that I can stay with, so I am building my case, and hope to get
something scheduled for this summer. Although one cannot claim for punitive
damages (those are at a judge's discretion) I believe that we will have a
good case for this, which can triple the awards.

He's young, fast talking, and thinks he knows more that he really does.
I've had terrible luck with Tom, and we aren't on emailing-terms these
days. The table of stuff he and the QAUG folks were hawking at the show
was old, dusty, and not particularly attractive. I doubt if they sold
much of anything.

IMHO, Tom needs to learn a lot about customer service, proper shipping
and handling methods, and general business dealings - just because
somebody has a great eBay rating doesn't mean they aren't a wacko. ;-)

Actually, his rating is currently 181 of about 225 separate buyers. That
means negative feedback on approximately 10%. His recent ratings are
worse. For my part, I paid for my item a year ago, and it has not shipped,
and now I don't really need it, but he doesn't respond to email when I ask
for a refund. Last heard from him in Jan. with a promise to ship and send
a tracking number...

Based on another incident I've recently been made aware of, I'd have
to take back my comment about using scammed as a harsh word. I will
no longer buy or sell anything to this person. Others should take
this as a warning to be careful.
