homeowners bad faith insurance claim

I have a bad faith claim against Farmers Insurance & I'm not sure how
to proceed. Any help would be appreciated.

I had a flood that was covered by my Farmers homeowners Insurance
policy.
The adjuster used a 3rd party to define the scope. The first scope
had some omissions that I discussed with the adjuster, who agreed to
include the added expense to the scope. The 3rd party revised the
scope & the adjuster & I agreed to this new scope. I repeatedly asked
for an official scope & was told by the adjuster that the 2nd revised
scope was the official scope.

The adjuster sent me partial payment of the claim with no explanation
& wouldn't answer my phonecalls. I finally called my agent who got
the adjuster to phone me. The adjuster said that she sent me partial
payment because if she sent me the full amount that she would have to
get her supervisors approval & there would be a delay. I repeatedly
sent requests for the remaining money that was owed to me.

After 5 months, the adjuster quit & now Farmers is claiming that the
partial payment was payment in full. I've had 3 adjusters on this
claim, who all just rubber stamp a denied on this claim without even
talking to me about the nature of the difference in the scope. I've
spoken to their supervisor who claims that Farmers can agree to a
claim & then deny it at any time in the future.

I've talked to an attorney who doesn't want to handle the case because
of the low amount of the claim (its too large for small claims court).
I've read the Fair Claims Settlement Act (I'm in California) & Farmers
has violated serveral sections of it.

Any advice on what to do next would be greatly appreciated.

I'd start by talking to my attorney. If you can't get an attorney to take it
on contingency (for a percentage of the claim), you could pay him out of
pocket.

Did they tell you that in writing? I've never seen a Farmers homeowners policy
that covered "flood". It's always been excluded.
Did they pay you "ACV", then tell you they'll pay you "Replacement Cost" after
you've replaced the items?

I'm foggy on what the problem is. Do you think they aren't covering certain
items, or do you think they aren't paying enough for the items you are
claiming? They should put this in writing.

Also, what kind of dollar amount are we talking about? How much did you think
you were going to be paid, and how much did they pay you?

Talk to a different attorney. If Farmers is found guilty of "bad faith" they
can end up with a judgement against them that is many many times more than the
claim.

I have a different problem with farmers. A farmer's insured hit my daughter in
a car....10 months ago. farmers just won't talk to me about either the
property damage or the bodily injury. Its not that they deny liability, they
just simply won't talk to me....period. Since I'm in California also, I am
hamstrung. Goobernor Gray Davis vetoed a bill passed two years ago that would
have allowed people in my spot to sue the other person's carrier for bad faith
if they "stonewalled". The Goobernor's own party had carried and passed this
bill. My only choice is to sue the insured's of Farmer's directly.

I have been in insurance for 26 years and Farmers is the one company that I
have consistently seen the most instances of sheer underhanded, dirty tactics
both to their own insureds and others.

Isabella is correct. Flood Insurance is only sold as a separate policy.
Many companies sell it but it really is a Government program. If it was a
true flood you would need this separate policy.
If it was water backing up through a drain in the basement, it is not
considered a flood.
For this you need a Water Backup Endorsement.
You may also want to contact your states Department of insurance.
If its truly a bad faith claim they may be able to get it resolved.

It is possible that the daughter was excluded from coverage, or that the policy
was expired. It's not Farmers you have to sue, it's this kid - Farmers didn't
cause the accident.
