Hey Mac,

Thanks for noting this, I just found out about it a couple hours ago.  No, I'm not involved in it nor did anybody from Six to Start contact me about it.  I haven't had a chance to talk with them but intend to soon, hopefully it's an extraordinary coincidence.

This is way out of line. I would start by seeking legal action.

I don't know why some are freaking out. It looks like a solid idea and
is fairly different than Zombie, Run! I don't see how any legal action
could be taken, considering that Zombie, Run! is a free app, and
development is pretty much dead at this point. Honestly, I can't wait
to see if this game lives up to that sweet trailer.

Hey all,

I just got off the phone with them, here's the scoop: the game's name
was not a coincidence and wasn't a mistake. They were very aware of
Zombie, Run!, but chose to go with the name Zombies, Run! anyway. I'm
still talking with them.

Personally, I think it looks like an awesome game, and I look forward
to trying it out :)

The only thing I could think of is the name is similar, thus violating the Zombie, Run trademark, and people might confuse the two,

People are definitely confusing the two.  I've seen many comments on blogs touting the Kickstarter project that believe it's an upgrade to Zombie, Run!.  At least one member of the open source team that helped me develop it in the early days thought that it was an upgrade, too.

Well, it should be noted that this is not an upgrade of Zombie, Run!, it's a different game that's being built by different people.

I'm not sure about trademark law, but you might have a case if you want to persue it. I don't remember if you need to register trademarks or not for protection. You should look into it, in case politeness doesn't work

I loved Zombie, Run! On my android, but since I have a Iphone I really miss it for this phone..

Yes, trademarks do have to be registered with the Patent and Trademark
Office, just adding the letters "TM" doesn't make it official. A quick
search of the PTO database shows that neither "Zombie, Run!" nor
"Zombies, Run" is currently trademarked, but a whole lot of other
zombie things are.
