Recently, a few people have contacted me enquiring the issues raised in newspaper articles suggesting cases on plots allotted in Sector 18 and Sector 20 at YEIDA. The questions are quite wide ranging.
Majority want to know... if their plots are 100% safe?
Well, technically the answer is No. There is nothing like 100% safe. No one can guarantee that. The courts can take any decision based on law and its wisdom.
Many want to know... if the plots are going to get cancelled?
Well, no one knows that 100% either. Plots have been allotted by government authority. Technically they should be safer then the plots allotted by a private builder and government is going to do everything possible to safeguard them. IF we are able to represent the allottee properly and display clear case of third party interest, it will not be easy for any court to cancel the land acquisition notifications.
Some want to know... the current status of cases.
Farmers continue to file cases, as we speak. Dozens of cases have been filed this week alone. However, the court has ordered the cases of each village to be clubbed together. The process is continuing and is expected to take another 5-10 days. Once clubbed a bench of two judges will listen to the cases and then deliver their judgment.
Others want to know... what we, at YERWA, are doing to safe guard our interest?
We took first step in July, when we met at Greater Noida. An informal announcement regarding formation of YERWA was made. The association was formed in September. Membership forms were sent in October.
Besides that, we are in touch with a lawyer, Mr. Tarun Agrawal, at Allahabad Court. Apparently his father, Mr. Ravi Kant Agrawal, represents Government of Uttar Pradesh. I’m informed by Shri. Tarun Agrawal that Shri. Ravi Kant was instrumental in presenting the government’s side during the trial of cases filed by farmers of Noida and Greater Noida. I am also told that Shri. Ravi Kant Agrawal will be representing Uttar Pradesh government during the trial of cases filed by farmers of Yamuna Expressway. For the time being, Mr. Tarun Agrawal has promised to file Caveats and Intervention Application on YERWA’s behalf. I have already sent 40 odd Vakalatnama to him for the purpose.
Mr. Tarun Agrawal was introduced to me by one of members of this forum. Mr. Manish Gujaral, an Architect and a resident of Lucknow/Allahabad suggested I speak to Mr. Agrawal. None of MC member has met him and only I have spoken to him over the phone. Subject to permission from General Body on Sunday, we plan to visit him and meet him soon.
Our immediate task right now is to enrol as many members as possible. Once we have 10% of total allottee as members… that will be 2,100 members, we can then relax. Until then we all have to be on our toes.
