Complaint Filed against Allan Osborne

The Florida Elections Commission has received a complaint alleging the
Samuel A. Osborne violated state statutes for failing to mark a political
advertisement with a proper disclaimer. The Commission has given Osborn the
choice of either accepting the charge and paying a small fine, or denying
it and face a full investigation and paying a possible much larger fine.

In a letter dated September 21st, the Commission says the matter can be
considered a minor violation if certain criteria are met. The conditions
include the violation, this being the first time the person has violated
the rule, Osborn agrees to correct the conduct if feasible and the person
must be named and the complainant must not allege that the advertising was
either deceptive or influenced the outcome of the election. The Commission
says this case meets the criteria.

The letter says Osborn can choose to resolve the matter by neither
admitting or denying the allegation, but paying a small fine within 20
days. If Osborn does not accept the offer, the Commission says the case
will be investigated. The Commission will then hold a hearing. If Osborn is
found at fault, there could be a $1,000 fine for the violation.

The letter ends with a warning that Osborn can not discuss the case, but
can seek the advice of an attorney. The person who made the claim is not
prohibited from discussing the matter. The letter indicates that Robert
Nelson filed the complaint.

Nelson was a recent candidate for Walton Commission seat 1. Before the
August 14th election, Osborn handed out copies of a packet talking about
candidates he opposed. Osborn gave a copy of this to WZEP. A second packet
copy is reported to also make statements of candidates he approved of.
Walton Commissioner Cecilia Jones was cited in the packet with numerous
complaints or statements by Osborn or the author. Several candidates talked
to WZEP and indicated they did not believe the statements were accurate.
Though others said they felt they had the right to file a complaint, Nelson
is the only candidate who indicated he would pursue action. There has also
been questions about the venues the packet was handed out at and the
persons who participated in the distribution.

DFS Meeting

Ellen Mayfield said her heart if filled with gratitude for Ed Joyner, who
is retiring at the end of this month. Mayfield works with a number of
community projects and says Joyner has always helped her with any needs and
called him a team player. She said the city workers need to be thanked more
often.

DeFuniak Springs Planning Director Greg Scoville has been removed from his
job after refusing to take a required random drug test under the City’s
Drug Free Workplace policy. Scoville read a statement. He said he believes
the random drug testing policy violates his legal rights. He said he
supplied a copy of a case where it was challenged and they prevailed.
Council member Kermit Wright said if they set a precedent, then they will
have to throw out all aspects of the drug testing. he says he thinks it is
important. Wright and Mac Work both said they can have their names put into
the testing pool. The Council approved the termination 5-0. City Manager
Sara Bowers said they send in the names to a company who randomizes them
and sends someone out to test.

The Council approved a renter opening the community center an hour earlier
for a wedding after the happy couple asked for the help, approved a
community center fee waiver for Walton Middle School’s Mother’s Day
fundraiser for the ESE Technology Department, approved closing roads for
the Homecoming parade, hired someone to assist with Christmas Reflections,
agreed to appoint Jean Anderson to the Christmas Reflections Board due to
her ability to fluff, approved a fee waiver for the Chautauqua Building and
Amphitheater for JRAFROTC for a Military Ball and a 5K race, approved a
group to use the amphitheatre and to decorate a tree for an Alzheimer's
event on November 3.

Ellen Mayfield asked the Council to consider adding $50 to the Chautauqua
Hall renter’s fee for Christmas use. She said people who come can cause
traffic backups and more, then they go around the Lake but do not pay to
see the lights. Council member Kermit Wright suggested that anyone going
through the gate should have to pay the entrance fee. Mayor Carpenter noted
some who come are helping provide for the city such as when they hire local
catering. Attorney Adkinson noted they would have to change the ordinance.
He said anyone who needs to go to the Chautauqua Building can simply park
across the street and not go around the Lake. Council member Kelley said
charging everyone the $3 would make sure Christmas Reflections benefits as
everyone pays the same. Council agreed that once the barricades go up,
anyone entering Circle Drive would have to pay, no matter where they are
going. The only exception is the residents who live on Circle Drive. Those
renting will be advised ahead of time. Later in the meeting, Carpenter
asked about paying for some such as the league of Cities to see the lights
as the come from all over to hold a meeting at the Chautauqua Building.
Council agreed they would simply buy tickets for the group.

Wright then suggested adding $50 to the Chautauqua Building rental fee to
go towards the elevator fund. He told the Council liability scares him and
the stairs scare him. The fund is $34,000 away from being able to put an
elevator in the building. Wright suggested taking $34,000 of the old health
building funds and apply it to the elevator. The $50 fee would go to repay
the fund. Wright said they need the elevator. Mayor Carpenter said he does
not agree with taking the money from the old health building.

Wright suggested moving the budget’s organizational requests to a later
date. He said when they consider what the organizations should get, they do
not know where the budget will stand. Wright says they should pay police
officers and workers then if there is something leftover they can help the
non-profit organizations. He says they should not base disbursement of
funds on what they received last year, rather on how many citizens are
served by the organizations. Kelley agreed that workshop would be a good
thing.

The Council approved an interlocal agreement with the County for building
inspection services and approved an agreement with the police union for an
annual raise.

And if you are going to be boring, you have to pay. The Council approved
requiring customers who need line boring to pay for the additional service.
