I'm concerned about the copyright notice that appears on each WebGL Earth image derived from Bing: "Copyright © 2013 Microsoft and its suppliers. All rights reserved. This API cannot be accessed and the content and any results may not be used, reproduced or transmitted in any manner without express written permission from Microsoft Corporation." 

How does this play into use of the WebGL Earth foundation in a commercial application?

Hi Michael,

You have to register and get your own SDK key from https://www.bingmapsportal.com/ for proper licensed use in your web application.

There are also alternatives to Microsoft Bing - such as MapBox Satellite or MapQuest Open Aerial Tiles.
