Legal action against Neils Cook (aka NC, cook_N etc.)

In the light of Mr. Craig's act of net-abuse in revealing the contents
of a private e-mail message from me to him earlier today I feel it is
only appropiate that the following be posted.....
This e-mail was sent to Mr. Cook early this morning (Sunday), as yet I
have received no reply from him. Since it is of a public nature and
requests some proof of Mr. Cook's status from other people it is only
fitting that it should recieve a public posting.
If you can answer any of the relevant questions concerning Mr. Cook I
would be very grateful if you could and it would be in the interests of
Mr. Cook if you do. Replies from people above reproach will be
considered only. I believe there may ba a nest of vipers about to be
uncovered but that will only become evident within the course of time.

Your Residential Address.
If you fail to give this to me freely of your own will I will send a
letter to postm...@actfs.co.uk informing him/her of what this is in
connection with and if neccessary telling your employer (assuming this
is where you work) of the activities that you use their internet
facilities for.
I hope that it will not come to that, but if it does I will not hesitate
to give that information out.
I am also interested in the following information out of my own
curiosity in finding out exactly why you are posting in this newsgroup.
(1). Has anyone ever had you buy anything from them ?
(2). Has anyone ever actually bought anything from you ?
Since this is a forum for buying and selling goods if I hear nothing
from anyone to the affirmative (from anyone other than you) with regard
to the above two questions I believe I will have an excellant case for
"net-abuse" against you and I shall seek to have you de-barred from the
internet as soon as possible !
It is my belief that you are nothing more than a cheap trouble maker (at
the very least and possibly something worse) and the sooner you are got
rid of the better.
I shall wait until Wednesday 3rd June for answers to Questions (1) and
(2) and if I hear nothing by then I shall draw my own conclusions.
The investigation for net-abuse and the legal case for "slander" are two
seperate issues and I shall pursue both or one or the other according to
whichever I believe solves the problem of this man Mr. Neils Cook
posting whatever lies he can dream up whenever he feels like it, as
expediently as possible.

PS. I have the records of previous e-mail conversations with other
members of this newsgroup and the possibility of pursuing legal action
over those I would not at this point totally rule out.

Far be it for me to intefer, but you can't bar Niels from the Internet, at
best you can only make the service provider he is using bar him. He would
then simply move to another. In any case, IMO Niels is a valuable
contributor to the groups he does post to, and those he has posted to in
the past. He strikes me a nice decent person, and I think your attacks
on him go a little too far.
As for your legal action for slander, I wouldn't have thought that it
would get very far. Not being a legal expert (but that won't stop me
commenting), that seems a little over the top.
Niels is probably just stirring. Just rise above it if it irritates you,
and ignor him.

could simply have edited it, and there'd be no way to tell which was
the real email.

They are admissible. Anyone wanting some inside info might consider
contacting Laurence Godfrey (the first person to recover damages
in the UK courts for a Usenet libel - he posts regularly to uk.legal).

No, but you *can* obtain an injunction to restrain repeated or
threatened libels.

If I see a post advertising goods for X ukp and a second post saying that
similar goods can be had elsewhere for (X-N) ukp then the second poster
has (potentially) given me valuable assistance.

Some useful points for posters and those aggrieved by posts to bear in
mind:
1. Defamation on Usenet is Libel, not Slander.
2. In UK, Legal Aid is not available to pursue or defend defamation
actions.
3. Defamation actions are notoriously expensive in terms of legal fees
and notoriously uncertain as to their outcome.
4. Always obtain competent professional advice before commencing or
threatening an action for defamation.

What Bill is saying is that in order to subscribe to this newsgroup
you will have had to have bought or sold something. If not, for
instance you tried to buy something but it was sold already, or you
couldn't sell some old kit, or you just want to know what prices are
in the UK, then this is net abuse and you denied access to the
Internet. Interesting idea that.

position which arises when a potential Plaintiff republishes in an open
forum the alleged libel of which he complains. If they're really good it
will take them a couple of hours to perform this research and their rate
of charge is unlikely to be less than 250 ukp per hour.

Actually that was a ploy in the hope of flushing out an even bigger
libel against me (Remember I said "Bait a sprat to catch a mackerel").

Don't you think you outta take it eezy a bit man, having just

Although I agree that Bill is a pain, he was probably replying in uk.a.p

I believe in a "live and let live" world where people are allowed their own
opinions even if that upsets a few. From what I've managed to grasp of the
situation prior to me "logging onto the group" so to speak, is that some
people think your prices for equipment are inflated. I don't know if this
is correct, as I don't know what is considered acceptable. The reason I

charging for the items I wanted.
I ended up buying what I needed from my local computer supplier and was
disappointed in not being able to aquire "stuff" off the net, where I
thought with the number of people involved it would have been quick and

All I can say on the matter of prices is that no-one held a gun to my head

Porno, I've said this before, you really do need to seek medical
help. You could have made a business in this newsgroup, flogging
stuff to punters as you call them, on the basis that they didn't
really know what it could be bought for. Instead, you have frightened
them off. Based purely on your postings in this newsgroup, I would
warn off anybody considering trading with you.
When I first started in my job many years ago and had to go on the
beat, I attended a week long course to help me identify mental
illness in others and how to cope with it. It was purely for my work,
and did not purport to make me capable of actually dealing with the
illness itself. One thing that was made clear was that if the actions
of others made me feel uncomfortable, if their reactions were not
would normally be expected, then it was time to start thinking along
the line that I may be facing a problem.
Porno, your actions are not normal, nor what one would expect. No one
gives a toss if you have a PhD or not, why then do you keep posting

find work. Could it be that you display the same behaviour patterns

I did not word it in such a way that imposed my moral judgements upon
him but tried to access his own morality and suggest things that would
be acceptable to him in the way he was going about things.
Thus I tried to give him my opinion of what might be considered good
advice for him.
He crossposted his article into uk.adverts.personals and one of the
cross-posts was alt.sex.incest. I saw that and thought I would try and
make a joke about it. Unfortunately the joke was not in the best of
tastes and I am sorry that that was turned against me (when quoted
outside the context of the rest of the article it does look a little
bad).
My intention was to give fatherly advice and have a bit of a joke at the
same time.
After I posted this article I promptly forgot about it, never dreaming
that it would come back to haunt me. However since it is now in the
open I feel that it can only serve as further evidence of my good
character against those who try to drag my name into the mud.
When this information was posted to UAC it was dressed to look like I
was a pervert. Only the most damaging parts were cut out in order to
blacken my name.
Everybody who took part in that activity will now have to face answering
some pretty tough questions.
I trust you are all prepared to do that since those that do not will
find themselves publically coming under the label of "COWARDS".

PS. My apologies to Mr. G. Bell for not answering any more of the points
he raises since I feel that he and the pro-flamers should re-examine
