The GloucesterTimes has published some
corrections to reporting errors in their original
story, but apparently no retractions of their
errors. Few readers would notice the story
changes unless they were pointed out to them.

Global theft charges dismissed vs. Rockport man

ROCKPORT ­ A Peabody District Court judge has
dismissed charges of larceny and obstruction of
justice against a Rockport man who was accused of
failing to deliver counter surveillance equipment
to a Swiss company yesterday ­ and still faces a
number of weapons charges as well.

Judge Richard Mori on Thursday dismissed the
theft and obstruction charges against James
Atkinson, 46, of 31R Broadway because the state
prosecutor's witnesses ­ one from Switzerland and
the other from Tennessee ­ did not show up for
the trial, according to both Atkinson's attorney
and the Essex County district attorney's office.

Atkinson had been arrested on the charges in
2009, after two foreign companies contacted
Rockport Police alleging he failed to deliver on
the counter surveillance gear he promised.

"When all the evidence and records came together,
it irrefutably proved that I did absolutely nothing wrong," Atkinson said.

Carrie Kimball-Monahan, spokeswoman for the Essex
County District Attorney's office, said the
charges were dismissed because, without
witnesses, the state couldn't prosecute. The
charges have been in court for 2 1/2 years.
Atkinson's attorney, Paul Andrews of Denner and
Pellegrino LLP in Boston, said the state didn't
have probable cause to charge Atkinson in the first place.

Atkinson's initial arrest came after a complaint
from GAZ Turbine Services, a Swiss firm that
produces technology and equipment for the oil and gas industry.

The Swiss company had contacted the Chamber in an
attempt to find out if Atkinson's purported
Granite Island Group was a real business. The
caller told the Chamber that his company
purchased surveillance equipment from Atkinson's
company for over $32,000, but that it never
arrived, according to a report written by
Rockport officer Daniel Mahoney. The Chamber contacted police.

Atkinson reiterated Thursday that his company
serves as a go-between for companies looking to
purchase counter surveillance technology and companies that make it.

GAZ Turbine paid him $32,000 for the equipment,
and he sent the money to Tennessee-based Research
Electronics International. That company
manufactures and ships the counter surveillance
equipment. Without proper export documents
stating the end user of the electronics, Atkinson
said, the company can't ship them.

According to Andrews' motion to dismiss the
charges, GAZ ordered the equipment in October
2009. Soon after, Atkinson paid REI for the
equipment, but REI said it needed a letter
declaring the end user of the electronics. GAZ
didn't send that letter until Nov. 23, according to court documents.

Stephen Spring of Spring and Spring LLP in
Louisiana, Atkinson's second attorney, said the
charges shouldn't have been brought forward in the first place.

"(GAZ) used the police department for extortion,
threatening criminal charges when they're the
ones who didn't supply the proper documents," Spring said.

Andrews' motion also cited that, during Rockport
Police's investigation, Atkinson and his
attorneys stated that when Mahoney called him, he
did so on a recorded line. A line, they stated,
Mahoney didn't state was recorded until about
seven minutes into the conversation.

Atkinson will face trial in Salem District Court
on a total of 16 other charges stemming from his
arrest, including several charges of possessing
firearms and ammunition without a license, and
possessing high-capacity firearms. Drug charges
and an allegation that he illegally possessed a
rocket launcher have also been dismissed.

He is also representing himself in his own civil
rights suit targeting the town of Rockport and
other defendants in the first Circuit Court of Appeals.

In Victory the Government misleads through press - in loss the Government misleads through press. Along with the resources sent out earlier by others I encourage people to look into "Three Felonies a Day" by Silverglate.

I am truly happy to see that James was successful where so many others have not been. And even in success the fight isn't over for him to be sure. Time and monies lost, reputation, the gray hairs.. and, I'm sorry to say, some Prosecutors don't stop and Prosecutorial misconduct is hardly punished.

Further to this email, the news media relies heavily on the FBI for intelligence.  They know they are in for big trouble if  anything critical about the FBI is published.  A good example is my civil case.  The two agents claimed an aggravated sty in the eye and aggravated hemorrhoids... oh, not to mention, they also wanted $22,000,000.00 .  Absolutely NOTHING appeared in any US paper or any other media.  The only people who dared mentioning it were all offshore... England, Saudi Arabia, Korea, South Africa and many others.

The failure of the media to run full corrections appears to be aimed at
heading off liability and legal/financial punishment as well as curry favor
with official news informants who are also at risk of Jim's wrath.

Cryptome would welcome helping correct the record if Jim's wants to
provide an account for publication. This is not meant to lessen more
direct action to punish commensurate with the villainy familiar to
anyone who dares question official malfeasance cowering behind
secrecy.

It still goes on Marty,look at the statement from the 
prosecutors office:

They had nothing,nothing but deceptive bs aimed at screwing with one person. complete fng bs.they allowed this to go on for over 2 years forcing jmat to pay legal fees,stress over it,lose business and then prosecution decides oh oscar green and blue are stuck on sesame street w no bus fare money and cant make it,and OH the chamber is having its welcome to rockport gala for the migrated homeless so they cant make it either,lets drop all of this.I hope to god that DA's office never tells anyone they're in the law enforcement business....

If they didn't have any witnesses to prosecute with,who and where were the witnesses that 
created the initial complaint??the cops were the witnesses that got the 
warrants,they were the ones who made a sworn statement to the court to 
get whatever warrants they allegedly did get.Did everyone hide under the desk at the chamber of commerce when the summons to appear showed up?What about the witnesses from Tennessee didn't show up? They more than likely took the time to make complaint but couldn't back it up by attesting to it therefore making them @@%@%^ until proven otherwise..
Essex co knows their plebes screwed up lets see what they do to fix it.

A stack of Summons and Subpoenas were issues and the witnesses actually refused to show up.

The arrest warrant was found to be fictional, they never had an arrest warrant, and the document they claimed was an arrest warrant had no signature on it of a judge or magistrate (which under U.S. Law they actually have to obtain before the arrest). So essentially I was arrested on a fake warrant (I have a copy of the fake warrant), and the office claimed to have a warrant which indeed he had no such thing. Oh-My, can you spell "Civl Rights Infringement", "Kidnapping", "False Arrest". Then when the discovered that I havd been arrested on a fake warrant then scrambled to confect a second case to try to hide the fake warrant and the lack of probable cause on the first case (which was just dismissed), then in the middle of this they (the Rockport Police) find out that not only did the goods ship, but the customer form Switzerland actually had the goods in hand. Of course Rockport Police, and the DA withheld this information until about a month ago, and everything suggests that they intended to hide this information at all costs.  The government knew that had no case the whole time, and they knew the whole time that none of the witnesses woudl show up, but what really sunk them is that I had tens of thousands of pages of evidence, and statutes, and laws, and treaties, (and hundreds of past REI order were they did improper exports, but were claiming they were getting licenses, which they were not) that proved that I was the only honest person in the transaction.

They had no probable cause
The arrest warrant was not signed by the court
The concealed evidence that proved I did nothing wrong
They concealed proof that the customer actually got the goods
There is proof the FBI was partially pulling the strings of the local cop

Then there was irrefutable proof that even though I was jumping though hoops to get end user letters and suppling them with the orders that REI was not actually obtaining the required license to perform the exports lawfully, and hence they were smuggling arms in a huge way (and the customer in Switzerland was also smuggling arms as they had no license to import these arms.  This is all laid out in detail in the Federal Civil Right (and Racketeering, Arms Smuggling, ITAR violation) lawsuit. Yes, I knwo the lawsuit is 2174 pages, but if you are in the TSCM business you need to read it, and search out certain key points and details.

I read in the Gloucester Time a few days ago that the City of Rockport was looking for a new police chief.  They actually be looking for a whole new police department!   Marty

The Town of Rockport will be looking to replace 9 to 10 police officers on an emergency basis.

Quite remarkable is that this will mean that more then half of the department will need to be replaced.

Notice that they actually confirmed that I paid them in full for the goods, but that they needed a better end user letter as the initial address the customer gave was bogus.

So REI had the money to pay for the order in full the entire time, and  all that was needed was the end user document, which you can clearly see was not even signed until 11/23/2009 (two business days before I was arrested). They rejected the first one as incomplete, and the customer in Switzerland went ballistic become they refused to disclose who the end user would be, and then when they did, it was so cryptic that nobody could figure out what they were talking about, and then they refused to get their actual customer to sign off on the required end user letter.

The initially claimed that the company in Switzerland woudl be the ned user ("ZeroMax") and then they changes it a few months later (to "FinGasCom") and then in October they claimed a new end user by the name (of "GTS") then thier changed in again (and claimed "CEMS") but they refused to supply the legally required documents.

Keep in mind that REI already by my money (see attached), and had been paid in full the whole time.

The Rockport Police knew that I had already paid in full for the goods, and that the only hold up was the end user certificate, which eventually got issued on 11/23/2009.

On 11/30/2009, REI confirmed that get the end user document, after my having to send it to then one, and then a day later 3 more time, when they got it, confirmed it, read to me off of it, and then lost it for a few hours and ask me to resend it.

The goods shipped to the customer the very next day, and was actually received by the customer 4 days later.

The matter was closed, except for a little problem: on the day they REI reopened for business and confirmed (and the fourth sending of the documents) that the goods would ship. I get arrested  the net day for not shipping the goods, and at the exact same time I was being arraigned in handcuffs UPS was processing the shipment after REI had handed it off to them for export. Oh yes, one other point, the customer confirmed reciept of the shipment to the police and the police concealed this little detail from the court for 29 months.

Yep, one whole day passed, the customer got the goods, I paid REI, and REI confessed to confecting a delay and working closely with the Rockport Police to set me up (and the Rockport Police admit to working with the FBI and Customs to set me up). So exactly who is pulling what strings?

perhaps you spoke with the wrong people and didn't approach media outlets like Radio Stations, usenet, irc, and advocacy groups. Also helps if you look into World Organizations and good old fashioned word of mouth. 

Probably get handed the "blue pill" and force fed though Neo.
