I have the DXF files for the gingery lathe and shaper and drill press
derived from the books authored by Dave Gingery.Can someone please
tell me if I legally post them on thingiverse. Is there some way to
post them and credit Dave as the artist sufficient or do I need his
approval?

IANAL, but this isn't the same thing as redistributing and making
derivatives of the book, not devices/inventions. On that note, can I

in exsistence for a very long time. If the files you post are not
directly from the book but derived from it then they are not part of
the copyright of the book its self.
I have copies of all the books myself and have been intending on
constructing either openscad files or just plain stl's of the devices
but havent gotten around to doing it with all the other things im
working on right now.
so, while contacting them to at least make them aware of your actions
would be polite, as long as you arent posting pictures directly from
any of the books you would not be violating any copyrights.

If I understand correctly, these DXF files would contain drawings re-created from our books that include all the dimensions required to create the individual parts for our machine tool projects. It is also my understanding that DXF files can be viewed on a number of different software programs so that anyone with the software would be able to freely view re-creations of the construction drawings found in our books. If all of this is true, then we would view the content of these files as part of our intellectual property and I would not be willing to give my permission for their release as open source files.

I do not believe that dimensions are copyrightable, and therefore DXF files containing the drawings would not be a copyright violation. However, if the claiming IP holder feels otherwise perhaps it is better to find a different source.

You could modify the parts - make them better in some way and then you
probably good - IANAL - but I think that just posting up *redrawings *of
whats in the books is probably not cool - legal or not (just my $.02)
3D Models I am not sure at all about - but I'd probably feel like the same
- that you were stepping on Vince's toes a bit - since you could basically
build one of his dad's machines without buying his book

That said, there are many modifications out there.
I am no lawyer, but it is common for a 15% improvement to be considered a new item.
If I were to do this, I'd add a link and urge people to buy the book. Just giving the info out as 3d models is not enough to construct the machine.
Speaking of models, a scale model might avoid all the fuss and be 3d printable, to boot.
Given Vince's response, it will be an uphill battle. If you can convince Vince that it might spread the word and add links to his books, that might help.
This is Vince's legacy from his dad, and he will not want to do anything to diminish that. But improving his sales might be viewed differently.

I posted this under another thread re DMCA takedowns, but it is equally relevant here. This topic needs wider attention, particularly for the general public, to no loose rights we currently have as I expect big business is not happy...

It's going to be messy, but not much is going to be protected in the future. We need to protect our rights too.
