Obama administration spied on Fox News reporter James Rosen: Report

The Justice Department spied extensively on Fox News reporter James Rosen in 2010, collecting his telephone records, tracking his movements in and out of the State Department, and seizing two days of Rosen’s personal emails, the Washington Post reported on Monday.

In a chilling move sure to rile defenders of civil liberties, an FBI agent also accused Rosen of breaking anti-espionage law with behavior that— as described in the agent's own affidavit — falls well inside the bounds of traditional news reporting. (Disclosure: This reporter counts Rosen among his friends.)

The revelations surfaced with President Barack Obama’s administration already under fire for seizing two months of telephone records of reporters and editors at the Associated Press. Obama last week said he makes “no apologies” for investigations into national security-related leaks. The AP's CEO, Gray Pruitt, said Sunday that the seizure was "unconstitutional."

The Obama administration has prosecuted twice as many leakers as all previous administrations combined.

“The president is a strong defender of the First Amendment and a firm believer in the need for the press to be unfettered in its ability to conduct investigative reporting and facilitate a free flow of information,” White House press secretary Jay Carney insisted last week. “He also, of course, recognizes the need for the Justice Department to investigate alleged criminal activity without undue influence.”

The details of the government's strategy against Rosen sound like something out of a spy novel.

Investigators looking into disclosures of sensitive information about North Korea got Rosen’s telephone records and a warrant for his personal emails but also used his State Department security badge to track his movements in and out of that building, the Post reported, citing court documents.

The case began when Rosen reported on June 11, 2009, that U.S. intelligence believed North Korea might respond to tighter United Nations sanctions with new nuclear tests. Rosen reported that the information came from CIA sources inside the hermetic Stalinist state.

Investigators zeroed in on State Department arms expert Stephen Jin-Woo Kim, who was among a small group of intelligence officials to receive a top-secret report on the issue the same day that Rosen's piece ran online.

But FBI agent Reginald Reyes wrote that there was evidence Rosen had broken the law, “at the very least, either as an aider, abettor and/or co-conspirator,” the Post said.

And just what did Rosen do? Here's Reyes, in an affidavit to support his request for a search warrant:

“From the beginning of their relationship, the Reporter asked, solicited and encouraged Mr. Kim to disclose sensitive United States internal documents and intelligence information about the Foreign Country," the FBI agent wrote. "The Reporter did so by employing flattery and playing to Mr. Kim’s vanity and ego.”

"Much like an intelligence officer would run an clandestine intelligence source, the Reporter instructed Mr. Kim on a covert communications plan," Reyes said, explicitly comparing reportorial tactics to espionage.

Here is how the Post described another section of Reyes' report:

Using italics for emphasis, Reyes explained how Rosen allegedly used a “covert communications plan” and quoted from an e-mail exchange between Rosen and Kim that seems to describe a secret system for passing along information.

In the exchange, Rosen used the alias “Leo” to address Kim and called himself “Alex,” an apparent reference to Alexander Butterfield, the man best known for running the secret recording system in the Nixon White House, according to the affidavit.

Rosen instructed Kim to send him coded signals on his Google account, according to a quote from his e-mail in the affidavit: “One asterisk means to contact them, or that previously suggested plans for communication are to proceed as agreed; two asterisks means the opposite.”

He also wrote, according to the affidavit: “What I am interested in, as you might expect, is breaking news ahead of my competitors” including “what intelligence is picking up.” And: “I’d love to see some internal State Department analyses.”

The communications system is a bit cloak-and-dagger, but it's not clear from the Post report or the affidavit that Rosen did anything outside the bounds of traditional reporting. People who know Rosen will smile at the Butterfield reference: The tenacious Fox News reporter is known as a Beatles fanatic, Tom Wolfe devotee and Watergate obsessive.

WASHINGTON (AP) — A Treasury official says the department told the White House twice that the IRS was preparing to make public its targeting of conservative political groups.

The official said Monday that Treasury told the White House in late April about a possible speech in which IRS official Lois Lerner would make a public apology and that outgoing Acting IRS Commissioner Steven Miller expected to be asked about the issue during congressional testimony. However, the official said Treasury did not give the White House advance warning that Lerner planned to address the issue during a May 10 conference, which she ultimately did.

White House advisers have said President Barack Obama was not told about the IRS targeting before it became public.

The official was not authorized to discuss the matter publicly and insisted on anonymity.

I admit it doesn't work as "correct" as the one I was using back when I had
Windows XP when Nutscape was usable.
But with the 'puter I have now with Windows 7 , the old Netscape isn't
workable.
So it doesn't format "correctly" to HIS standards?... so what? He's a known

Please note I use Windows 7, and I have absolutely no problems with using
the same software.

However, I do use a different, earlier version. Specifically I use Live
Essentials V14, since with V15 they screwed up the Usenet quotation.

May I suggest, again, that the simple solution for this is to simply roll
back your version of Live to V14 and eliminate the issue.

I've already posted a link to the Microsoft site where you could download
the V14 installer.

So, I'm not sure I would buy the above as a particularly valid excuse.

But whatever, if you chose to not correct it, then you have only yourself to
blame.

IRS's Lerner pleads Fifth, insists she's done nothing wrong

IRS official Lois Lerner said had not done anything wrong at a tense House hearing Wednesday but still invoked her Fifth Amendment rights against self-incrimination.

"I have not done anything wrong. I have not broken any laws. I have not violated any IRS rules or regulations," Lerner, the head of an IRS division overseeing tax-exempt groups that targeted conservative groups, said before the House Oversight Committee.

Lerner then said she was following her counsel's advice not to testify. "

"I know that some people will assume that I have done something wrong," she said. "I have not."

Through her lawyer, Lerner had given the committee a head’s up that she planned to take the Fifth.

House Oversight Chairman Darrell Issa (R-Calif.)asked that she reconsider, but she declined.

Issa then tried to dismiss Lerner, but Rep. Trey Gowdy (R-S.C.), himself a former prosecutor, said that Lerner had waived her Fifth Amendment rights via her opening statement. Issa eventually did dismiss the IRS official, but said she could be recalled.

[ It's a fact: once she says a single word, other than "taking the fifth,"
[ after being sworn in, she _has_ waived the "right to remain silent."

Issa and other top panel members had said that Lerner,the official at the middle of the uproar over the agency’s targeting of conservative groups, had misled them on four separate occasions in 2012 about the agency’s targeting of Tea Party groups seeking tax-exempt status – months before a Treasury audit detailed that extra scrutiny.

William Taylor, Lerner’s lawyer, stressed in that letter that Lerner had committed no crime, but that the Fifth Amendment was also in place to protect innocent individuals.

Lerner’s invoking of the Fifth sparked some early fireworks in what is now the third congressional hearing to look into the IRS’s treatment of conservative groups. Neal Wolin, the deputy Treasury secretary, is also appearing before the panel, marking the first time a senior department official has been called to testify on the matter.

In his testimony, Wolin stressed – as has his boss, Treasury Secretary Jack Lew – that the findings in the inspector general’s report were “absolutely unacceptable and inexcusable.”

But Wolin also said there was “no indication” that Treasury had any role in the targeting, and that the inspector general, Russell George, informed the department in June 2012 – after George’s report said the targeting ended.

“It is important in this context to make clear that Treasury’s longstanding practice – spanning Republican and Democratic administrations – is not to involve itself in the details of the IRS’s administration and enforcement of the nation’s tax laws,” Wolin said.

Treasury and White House officials have stressed that they were involved in discussions about how the IRS would disclose the targeting, but only found out about the details well after the fact.

But Issa and other Republicans remain far from sure at Wednesday’s hearing, with Rep. Jim Jordan (R-Ohio) linking the administration’s handling of the IRS controversy to the aftermath of last year’s terrorist attack in Benghazi, Libya.

Issa, meanwhile, noted that his panel had asked for the inspector general to look into the matter in 2012, saying “we knew then that there was smoke.”

The California Republican also noted that an IRS internal investigation had found similar targeting in the election year of 2012, well before the inspector general’s report, but also said that extra scrutiny was bigger than any one election.

He also criticized George, who is also testifying Wednesday, for waiting to inform lawmakers about his findings.

“The power to tax is the power to destroy,” Issa said. “It wouldn’t matter one bit if a different group was targeted.”

On the Democratic side, the panel’s ranking member, Rep. Elijah Cummings (Md.), said he hoped the hearing wouldn’t descend into a partisan sideshow, and said he respected Lerner’s decision to take the Fifth – even as he said he thought she could shed some light on what happened at the agency.

Rep. Stephen Lynch (D-Mass.) sounded an angrier note, suggesting that IRS officials had not been forthcoming enough and raising the specter of a special counsel if more answers weren’t on the way.

“There will be hell to pay if that’s the route we choose to go down,” Lynch said.

Issa said Thursday he had concluded that Lerner did not waive her rights against self-incrimination when she invoked her Fifth Amendment rights at a Wednesday hearing.

More than four years after he left office, former President George W. Bush's approval rating now equal President Obama's, according to a new Washington Post/ ABC poll.

Forty-seven percent of Americans say they now approve of the former president, while 53 percent disapprove, according to the poll, which surveyed 1,000 adults from April 17-21. Mr. Obama's approval rating also stands at 47 percent.

Mr. Bush left office under a cloud of controversy, taking blame from the public for the 2008 financial crash, the Iraq war and his handling of Hurricane Katrina in 2005. In an Oct. 2008 Washington Post poll, his approval rating was as low as 23 percent. By January 2009, when he left office, just 33 percent approved while 66 percent disapproved.

The former president's improved public image demonstrates how time out of office, and out of the public eye, can help bolster a politician's popularity. Mr. Bush may also get to refurbish his image with the opening of his presidential library this week on the campus of Southern Methodist University in Dallas.

Republican lawmakers hear complaints about wider abuses from IRS

Several Republicans say their constituents have come to them with examples of Internal Revenue Service intimidation that goes beyond the agency's targeting of conservative organizations applying for tax-exempt status.

Lawmakers in the House and Senate say they’ve been told of other examples of bullying since the IRS apologized for targeting Tea Party groups.

“Oh, there's a slew of them,” said Rep. Patrick Tiberi (R-Ohio), a member of the tax-writing Ways and Means Committee. He said several lawmakers on the panel had been given tips about over-aggressive actions by the IRS.

Tiberi is one of several lawmakers who went public this week with allegations of wider abuses by the IRS. He and the other officials acknowledged the complaints from their constituents could be true or false, and said that they intended to look into the matters.

"I'm certainly going to spend a lot of time looking into it,” said Sen. Tom Coburn, who heard complaints from constituents who claimed they were audited by the IRS after making substantial donations to Mitt Romney's 2012 presidential campaign.

The complaints come amid a wide-ranging scandal at the IRS, where a government watchdog report found some conservative groups seeking tax-exempt status were subjected to broader scrutiny because of their politics. IRS officials subjected groups with the words “Tea Party,” for example, to heavier scrutiny.

The acting commissioner of the agency was forced to resign over the matter, and Speaker John Boehner (R-Ohio) has suggested criminal charges could be filed in the matter. The Department of Justice is conducting an investigation.

So far, there is no evidence that the IRS went after individual taxpayers because of their political beliefs, but several lawmakers say they’ve heard complaints.

In an interview with The Hill, Sen. Orrin Hatch (R-Utah), the ranking member of the Senate Finance Committee, said his office had receiving an influx of stories about the IRS abusing its power. He said he'd just begun to review the claims.

“Well there are some really funny things that are going on,” Hatch said. “We're currently just looking at all of that. I mean look, let's face it, the agency is not exactly being run the way it should be run.”

Pressed for more details about the claims, lawmakers say they're in the early stages of actually investigating the stories. Hatch, who met with the new acting IRS commissioner this week, acknowledged his office gets a lot of complaints, some of which end up being good tips and some of which ending up being false.

“Yeah, we always get complaints,” Hatch said. “I mean some of which are good, some of which aren't.”

Republicans have urged constituents to come forward with examples of IRS abuse.

Sen. John Cornyn’s (R-Texas) office set up a web page encouraging constituents to come forward with examples of the IRS targeting Texans.

Drew Brandewie, communications director for Cornyn, says the response has been “alarming.”

“In the short time since it was launched, we’ve received nearly 60 stories of the IRS targeting Texans for their political beliefs, and it is not limited to just tea party members,” Brandewie said in an email to The Hill.

“Texans who have donated to conservative causes as far back as 2008 have told us they believe they’ve been targeted, citing excessive paperwork, lengthy interviews, intimidating communications from agents, and even audits of their small businesses. These include Texans who donated to Sarah Palin in 2008, Mitt Romney in 2012, and to groups like Freedomworks and the Heritage Foundation.”

In an interview, Cornyn said some of the claims might not end up being true, but that they need to be investigated given the IRS’s acknowledged actions.

“Well, you never know,” Cornyn said. “Nobody likes the IRS and we all sort of gripe about them but I think now there's some legitimacy to some of the griping and it goes over and above the usual irritation.”

While both parties have criticized the IRS’s actions, it has mostly been Republicans reporting possible wider abuses.

Asked whether her office had received a wave of allegations of greater IRS abuse, Hannah Kim, communications director for Rep. Charles Rangel (D-N.Y.) said: “Not that I know of,” in an email to The Hill.
