acceptable, leads to a pretense of tolerance.

tolerance, nor may it be an excuse for looking away from vital
problems that do exist:

I must point out, respectfully but insistently, that the refugee policies of
the Dutch Government have for years condoned unacceptable practices,
particularly discrimination on the basis of country of origin and the odious
crime of forced repatriation. Many persons fleeing injustice or brutal
violence have found themselves cruelly rejected and returned unwillingly to
places of pain and danger, while others, from other places, found acceptance
with little or no consideration of their individual experiences or the
merits of their individual cases

I am one such person. Corruption, moreover, has denied me and others an
effective remedy under International Law.
Your proclamation demonstrates the prime reason for my having chosen the
Netherlands as my first country of refuge. To this day, in spite of
everything, the Netherlands is the only nation on earth that I can truly
respect -- the only nation that showed me any real respect.
Won't you please set things right? Let the truth be told. Let justice be
done.

You do not correctly describe your situation, and therefore it
receives no remedy, and even less understanding - and understanding
is a vital ingredient for any lasting remedy.
Your education and intelligence, while high, have not been geared
towards finding the actual causes of your plight, and so it has
found no remedy.
And it is not a very fruitful undertaking to ask another, including
state officials, to generate compassion for and remedy what he or
she cannot grasp or comprehend.
Problems of your or similar nature have found my considerable
interest and compassion, over the past many years.

your understanding to that considerably higher level that is
required to grasp the actual and true causes of your physical
suffering and your mental torture.
You do not shun to face unpleasantness, nor do you lack the ability
to comprehend realities that are complex and entirely beyond your

causes - and so mitigating, alleviating or maybe remedying the
impossibility, described so well by you, of being heard and

I have followed the Google link to your earlier post. Your section on
Cowards impresses me. Because of my political beliefs and the free exercise
of my human rights (see "Here's How It All Came About"
http://www.angelfire.com/nj/jhgraf/hereshow.html on my web site), I am
harmed by a very powerful team of hate-mongers who have repeatedly ganged up
on me and destroyed most everything worthwhile in my life. I am harmed as
well by the cowards who help them cover up their crimes. The law is supposed
to provide an individual with protection against such persecution. My own
country consistently denies me that protection. I am a "non-person." My
circumstance is aggravated by wanton denial of the right to seek and receive
political asylum (a horror inflicted upon many, many others as well) and
further aggravated by corruption and coverup on national and international
levels.

Nobody should have any trouble understanding the issues. It's all about law
and the Rule of Law. It's about right and wrong.
Some countries, such as the Netherlands and Denmark, have voluntarily
yielded up some of their national sovereignty by ratifying certain
international agreements. These include the 1951 Convention Relating to the
Status of Refugees http://www.ufsia.ac.be/~dvanheul/genconv.html and its
1967 Protocol, the International Covenant on Civil and Political Rights
http://www.unhchr.ch/html/menu3/b/a_ccpr.htm and its Optional Protocol
http://www.unhchr.ch/html/menu3/b/a_opt.htm , and the Convention Against
Torture and Other Cruel, Inhuman, or Degrading Treatment or Punishment
http://www.unhchr.ch/html/menu3/b/h_cat39.htm .
Article 3 of the Convention relating to the Status of Refugees forbids
discrimination "as to race, religion or country of origin," yet, "safe
country" policies such as that of the Netherlands

the "accelerated procedures" to which certain refugees are subjected have
inflicted just such discrimination on me and many others. Article 33 of this
Convention forbids the involuntary return (_refoulement_) of a refugee "in
any manner whatsoever to the frontiers of territories where his life or
freedom would be threatened on account of his race, religion, nationality,
membership of a particular social group or political opinion." The Dutch
Government and the Danish Government have both committed this HUMAN RIGHTS
CRIME against me and others.
Articles 2 and 26 of the International Covenant on Civil and Political
Rights, as well, forbid discrimination on grounds of "race, colour, sex,
language, religion, political or other opinion, national or social origin,
property, birth or other status." "Safe country" policies and "accelerated
procedures" have nevertheless inflicted such illegal discrimination on me
and others.
Section 2 of Article 2 of the ICCPR, moreover, mandates that each State
Party "take the necessary steps, in accordance with its constitutional
processes and with the provisions of the present Covenant, to adopt such
laws or other measures as may be necessary to give effect to the rights
recognized in the present Covenant." Section 3 of that Article is a pledge
that a victim of rights abuses shall "have an effective remedy,
notwithstanding that the violation has been committed by persons acting in
an official capacity" and "have his right thereto determined by competent
judicial, administrative or legislative authorities, or by any other
competent authority provided for by the legal system of the State..." It
further mandates that "the competent authorities shall enforce such remedies
when granted."
Article 12 of the ICCPR includes the following: "Everyone shall be free to
leave any country, including his own." Returning a refugee against his will
to his own country obviously, and often tragically, deprives him of this
right.
Article 3 of the Convention Against Torture and Other Cruel, Inhuman, or
Degrading Treatment or Punishment assures that "No State Party shall expel,
return (`refouler') or extradite a person to another State where there are
substantial grounds for believing that he would be in danger of being
subjected to torture. For the purpose of determining whether there are such
grounds, the competent authorities shall take into account all relevant
considerations including, where applicable, the existence in the State
concerned of a consistent pattern of gross, flagrant or mass violations of
human rights." Note the phrase "all relevant considerations."
Article 13 of the Convention Against Torture and Other Cruel, Inhuman, or
Degrading Treatment or Punishment assures the right to complain and to have
one's case "promptly and impartially examined" by competent authorities. It
also forbids retaliation against a complainant or witness. Article 12
provides for "prompt and impartial investigation" where there are reasonable
grounds to believe that torture has occurred. Article 16 extends the
guarantees of Articles 13 and 12 to other "cruel, inhuman, or degrading
treatment or punishment."
Though I am not a lawyer (certainly not a Dutch lawyer), it is my impression
that the laws of the Netherlands do indeed reflect these principles, yet I
was denied the equal protection of those laws.
For such human rights crimes as discrimination and refoulement, a remedy
must be available under international law. With respect to nations, such as
the Netherlands, that have ratified the Optional Protocol of the
International Covenant on Civil and Political Rights or Article 22 of the
Convention Against Torture and Other Cruel, Inhuman, or Degrading Treatment
or Punishment, the United Nations committees mandated to accept and process
individual complaints under these instruments have proved grievously
unwilling to provide such a remedy.
