(c) Law, Policy and Practice Reform Research and Investigation. The
work completed focuses on how to use the Boards, Commissions,
Tribunals and Law Courts of the elected and appointed government and
its agencies to change defective policies and practices.

i. Mechanism for Peaceful and Non-violence Policies and Practices
Reform Techniques (National Chair, Litigation Team – 1999 – May 23,
2002). Under self-representation over nine lawsuits were commenced in
1999 and four have successfully reached the highest court in Canada
(Supreme Court of Canada). Two judgments have been delivered.

Sample and Brief Procedural history of one of these lawsuits:

Risk and danger facing the term and casual employees and supremacy of
Employers in Nova Scotia: Exclusion and marginality of the Nova Scotia
Labour Standards Code in labour conflict resolution. This lawsuit on
policies and practices change is an alternative conflict resolution
measure because mobilizing the mass-people (casual and term employees)
would lead to destruction of life and property. A lead Plaintiff/
Complainant was sought and established instead of class action. Fewer
parties would be preferred because of time, costs and efficiency.
Canadian government sanctioned all lawyers not to
represent the lead Plaintiff/Complainant who also read law. Plaintiff/
Complainant read and his members read law privately to protect public
interest and help government survive in formulating its policies. This
method prevents community, national and
international violent protest and civil demonstration to change
operating policies and practices.

Point at issue in this case interrogating Canadian Labour Standard
Code and Civil Procedure Rules:

a. whether term employee in Canada requires letter of employment;

b. whether term employee in Canada requires contract agreement
between employer and employee;

c. whether term employee in Canada requires workplace medical and life
insurance;

d. whether term employee in Canada need to be issued identification
card containing picture and names different from his/her names and
picture;

e. whether term employee in Canada need to be issued access or
premises entry card containing picture and names different from
his/her names and picture;

f. whether term employee in Canada is suppose to be paid over-time and
granted rest time during his/her contract tenure.

Decision/Judgment by the Canadian Board, Tribunal and Law Courts:

Comment – Majority of the Decision, Order and Judgment in Canada are
based on wide distinction of colour, race and nationality. Majority of
the direct and indirect Plaintiffs and victims in these cases are
racial minorities. Decision and judgment on these cases (hereunder)
all of which raised the issues (a) to (f) above were issued and
delivered by the Board, Tribunal and Law Courts and dismissed
accordingly without reason. Right as to publication and disclosure
has remained censored.

Hearing: Halifax, Nova Scotia May 23, 2000 and June 26, 2000

Breach of Law Courts Rules of Practice: On May 23, 2000 tapes 1, 2,
and 3 contain the entire case of the Appellant and tapes 4, 5, and 6
contain the entire case of the Respondent. To frustrate the case of
the Appellant, tapes 1, 2, and 3 were destroyed and the Tribunal
covered the atrocity and delivered judgement and dismissed the Appeal
without the case of the Appellant without informing the lead Appellant
that all his tapes were missing

STAGE III

APPEALED TO NOVA SCOTIA COURT OF APPEAL

Phillip Ofume v. Department of Education and Labour Standard Tribunal
File No. C.A. 166475. Labour Standard Tribunal resigned. The Appellant
knew about the missing tapes when he was perfecting this appeal. To
cover this atrocity the Labour Standard Tribunal filed sworn affidavit
to disclose the incident. The Tribunal and Department of Education
pleaded for the appeal be remitted back to the Labour Standard
Tribunal for Retrial. This affidavit led to appointment of jury. The
Honourable Justice Flinn was appointed. Justice Flinn was alarmed and
dismissed their
application for the appeal be remitted back for rehearing. Justice
Flinn assigned the case to the Nova Scotia Court Appeal Panel.
Nova Scotia Court of Appeal failed to consider the harm done to the
case by the Labour Standard Tribunal. At this stage the employers and
government have started making changes.

STAGE IV

APPEALED TO SUPREME COURT OF CANADA

Phillip Ofume v. Department of Education and Labour Standard Tribunal
- Supreme Court of Canada File No. 28956

Judgment delivered on May 23, 2002: The Canadian government and its
agencies took over the Supreme Court of Canada as they did from Board
to law court. The Supreme Court of Canada was forced to sweep under
the rug and ignored what transpired on the Tribunal and Nova Scotia
Law Courts levels especially the Order and Reason for Order of the
Honourable Justice Flinn. The Supreme Court of Canada refused,
neglected and failed to handout written Reason for Judgment. Due to
national and international demand for this Reason for Judgment, the

Supreme Court of Canada pull down and dismantled the websites whereat
the Judgement was published. This one of the major case law cited by
lawyers in Canada.

This research is identifying the Basic Human Rights vis-a-vis the
Universal Declaration of Human Rights(December 10th 1948) which have
been Ratified by Canada. Research/Investigate the Canadian Basic
Human Rights relevant to access to education, employment and
services protected by both the National and Universal Basic Human
Rights. Examination of various barriers and progress made by this
Community. Examination and Evaluation of the prevailing socio-
economic position of the African Canadian Community versus other
Communities in Canada. The target period is 1700 -present. This
Project is funded internally by ACHRA's Members across Canada.

ii. On-going Research Project:
"Questions of the Civil Liberties of Recent African Canadian
Settlers in Nova Scotia 1945 - 1998". Funding Agency – Self (Phillip
C. Ofume).

Method of Intervention:

Co-ordinating a Provincial Research Project that is identifying and
defining a "Special and forgotten Black Settlers" who started
emigrating from African, Caribbean, South America, etc. since 53
years ago to Nova Scotia. Before and after Fifty three years ago they

have been Black Settlers in Nova Scotia.

These Blacks known and to be called in this research the "Recent
Blacks" have not been defined by studies, various governments and
socio-economic development manifests in Nova Scotia. Neither have
they an official access to the Basic Human Rights and/or socio-
economic programs legislated within the jurisdiction of the Nova
Scotia Human Rights Act. Majority
of the Recent Blacks are excluded both by the indigenous Blacks and
certain government service providers from having access to different
socio-economic programs due to their language accent, colour and
place of origin.

They are not included in the ten first preference nations resettled
in Nova Scotia. The Recent Blacks are different from the indigenous
blacks and the rest of the Nova Scotians due to certain cultural
background such as spoken English and French , differentiation on
color pigmentation, impact of recent social mobility, religion,
creed, etc. There is no cause for this discrimination because they
are hard working, law abiding, many are highly educated and
speak/write English and French and excellent
entrepreneurs.

This research is investigating with the use of participatory action
research and traditional action research the school curricula in
primary, junior secondary and senior secondary and reason why there
are incessant black students drop outs especially at junior secondary
and senior secondary levels. The research is investigating the role
of the teachers, students, school board, parents, school managers and
black learners. A critical study of access to educational enrichment
and other services. Compare
black learners and other learners within a particular learning
community and Basic Human Rights sustaining learning environment.
Study and analyze the Nova Scotia Human Rights Act especially
educational equity, support program, race relation and affirmative
action.

(b) Refocusing the Race Relation Foundation Program in Nova Scotia

To examine the effectiveness of multi-cultural race relation program
and mono-cultural race relation program in the school, workplace and

study. To investigate over 22 prohibited and other grounds empowered
by the Nova Scotia Human Rights Act. Review of the prevailing race

communities to legal services to pursue cases of racism and inequity.

1900 This research will examine how Nationality Preference and Bloc

(24) EXHIBITION OF EXCELLENCE AND SPECIAL GIFTED TALENTS IN CANADA

(a) Resettled in Canada on April 20, 1998. As human empowerment and
development expert and specialist and someone who has never begged
tea and bread to help himself and others, I decided to study the
refugee resettlement one-time loan which was $5190.00(Canadian
dollars) and imported goods, properties and cash (added value for
shelter). Some refugees use this money for enjoyment but I found that
this money could be used to end the poverty of a refugee who lost all
following the flight to exile. Soon as this money was paid in full to
my family(four children and two adults), I decided not to touch a dime
outside the food for my

family. Thereafter, I decided to spend few days in reading,
researching and investigating Canadian social and economic
environment. My initial budget plan was the following:

i. Information and communication:

- Phone, Fax, Internet and access to e-mail;

- Computer and Printer

ii. Mobility and Networking

- Used Car/insurance/Gas

- Job Search (employment and self-employment)

At this point, we looked like new comers who have been here for some
years.

(b) About two weeks following our arrival, the plan in paragraph (a)
became a magnet or spring board for our success under government
sanction and reprisal. I found advertisement calling for researcher
with the Department of Education and Culture. Because all the
facilities to enhance the preparation of my application were with me,
I applied immediately. The project was $200,000.00 research grant by
the Federal government of Canada. The volume of the grant and
academic and professional prestige attached to the project attracted
several scholars across Canada. According to information about 108
candidates were short-listed for interview. I was short-listed. The
interview was conducted about one and half month following our
arrival in Canada. After the interview, I emerged first position. The
old scholars in Canada protested and the Canadian government
intervened and the Department of Human Resources was assigned to
review the interview. The apprehension of the Canadian government is
that I am a human rights activist… After the review, I was also
selected as the best candidate to take the research job. The Canadian
government annoyance did not end there…

(c) The foundation plan in paragraph (a) above continued to yield
success. This plan facilitated a national and international business
and NGOs formation breakthrough. The plan yielded the following
surplus:

i. mobilization of human rights activists across Canada to facilitate
the incorporation of six national and international human rights
NGOs (listed above). The Canadian government frustrated all the
plans, which we have put in place to develop Canada and Canadian
peoples in daring poverty which has been covered under heavily armed
police.

ii. less than nine months following our arrival the plan stated in
paragraph (a) above led to purchase of the present home in the best
place to live in Canada(Bedford). To frustrate


the rate of our progress or success the Canadian government imposed
the one of the worst world starvation wages (welfare or social
assistance) on us in 1999 to kill us;

iii. in the year 2000 in collaboration with governments and business
sectors inside and outside Canada, we facilitated a multi-million
export project on used trucks and other spare parts and machinery.
The Canadian government impeded the plan. A Commissioner with the
Canadian Department of Foreign Affairs and Trades wrote secret
letters to our different government and investment partners thus,
requesting them not to do business with us. The partnership was
strong multiracial/cultural team.

(d) In 1998 we were denied access to the right to read law. To pursue
the cases of human rights violation relating to our human rights
work, we started to read law privately and the plan in paragraph (a)
above gave us the excellent scholarship in the private study of law.
I lead my NGOs to pursue several cases from the Board, Human Rights
Commission, Tribunal, Provincial Law Courts to the highest court in
Canada(Supreme Court of Canada).

(e) I have earned a broad base globalization status with experience
in over sixteen countries including Algeria, Belgium, Benin, Canada,
France, Gabon, Germany, Ghana, Ireland, Italy, Nigeria, Senegal,
Switzerland, Togo, United Kingdom, U.S.A., etc. This cross-world
experience gives me the back up or ability to understand and manage
diverse academic, professional, business tradition, people,
multiculturalism program and the enhanced expertise to teach,
coordinate and research

issues bordering around and within a cross long range plan. This is
an opportunistic thoroughfare in planning and coordinating events;
prioritizing; time management; problem solving; Long-range planning;
goal setting; follow-up and evaluation with excellent assiduity.
