Motion to Refrain - The Payor’s Gambit Works in Canada You Say?

It’s still a bit early to make a broad and definitive statement but
there is every indication that the Payor’s Gambit is working.
Under a Motion to Refrain, the moving party is generally the
respondent father. This is somewhat unusual to the normal process of
filing for divorce or child support where the moving party is the
applicant mother.
If the father’s motion is just, it is one of the few opportunities for
the respondent to set the tone of a motion.
The applicant mother may make the mistake of doing what she has likely
done in the past, that is, making the first punch count. She makes the
mistake of thinking that her response is the first punch but it is
not. Her’s is a first response since the father has set the tone by
being the moving party.
As the mother’s previous gambits have shown mostly successful she is
likely to indulge in a litany of claims and accusations or innuendos
and inferences that are far from the refuting the father’s claim. She
is now extending the rope with which to hang herself. - the Payor’s
