Good point! This is why the birthrate stays so high and literacy low. They have to figure out how to empower women. If they can't fix civil law, just return it to the provinces with the "good faith clause" like the constitution.
Where does the constitution of India say that the government is responsible for providing "roti, Kapra aur Makan"? It is slogan crafted by communists, and is just that.

Laws in the spirit of the faith

Some months ago, the National Commission for Women released a report titled `Voice of the voiceless: Status of Muslim women in India'.
The study, prepared by Syeda Saiyidain Hameed, was especially critical of the practice of talaq ul-bidnat. In this a Muslim husband gets a divorce by uttering the word talaq three times. It recommended against the practice, widely prevalent in India, and responsible for the plight of many abandoned women. It cited the example of Muslim countries like Pakistan, Bangladesh, Egypt, Turkey, Syria, Iran and others that have reformed divorce laws to make them more fair.
The biggest irony is that in India alone the world's biggest secular democracy the Muslim male can get divorce unilaterally by uttering the word talaq thrice at one sitting, or even by putting it in a letter or telegram. Thus, the recent report by the All India Muslim Personal Law Board, the community's apex body for determining laws, has prepared a draft paper on reforms in marriage and divorce, is encouraging news. Except that Maulana Fahim Akhtar, the AIMLB spokesman has denied that the proposed changes go to the extent that has been reported.
All that he is willing to concede is that talaq ul-bidaat is the worst practice, and is slated to be discussed at the board's meeting scheduled for the end of October. The draft of a standard nikaahnama for the sunnis will also be considered. However, a report emanating from Lucknow, which quotes an executive female member, Ms Naseem Iqtedar Ali, as well as board member Mr Zafaryab Jalani, is more explicit. The suggested amendments apparently include the following: instant triple talaq or talaq ul-bidaat to be restricted and, instead, talq-i-ahsan and talaq-i-hasan have been approved. Under this system, a man can pronounce talaq once during a tuhr (about a month). After three tuhr, a period of sexual abstinence, when the word talaq is pronounced thrice, the divorce becomes irreversible. Other reforms being considered are the provision of adequate mehr to the wife, restriction of polygamy, and permitting the wife to exercise her right to divorce under Islamic law (Khula).
NCW Joint Secretary Leena Mehendale, while approving these possible amendments has voiced her reservations. One, whether the woman, on the divorce coming through, is expected to return the mehr amount, which she may have spent. And if she is not in a position to give back the money, what happens? She points out that those women who have not taken mehr at the time of marriage, forgo it when there is a divorce.
Two, in the event of the wife seeking divorce, if the proposal is approved, whether she can exercise the right if she is unable to return the mehr amount. This question needs to be seriously addressed. According to the report, the wife's right to claim divorce may be permitted in five situations. These are: when the husband's whereabouts remain unknown for two years; when he provides no financial support to his wife for a period of one year; when his mental health is uncertain; when the couple has been living apart for a year; and when the wife is subjected to cruel conduct by the husband, or he suffers from a sexually transmitted disease. Ms Mehendale's third reservation is with reference to the post-divorce period: whether the woman will get maintenance. She points out that the Shariat expects the man to provide a dignified life to the women. But the issue of providing maintenance after divorce is contentious.
Clearly, the path of reforms is it thorny. A number of Muslims in India are ignorant of the laws governing marriage and divorce. And the State, for fear of antagonising a vital vote-bank, will not interfere Progressive Muslims have to be at the forefront of any movement for bringing about changes in their personal laws; changes that are in keeping with the spirit of their faith.

How can the govt. provide roti, kapada and makan if the muslims keep dozens of wives and breed like rats?
Educating women and giving them equal rights should be carved into the constitution.
