People like to drink beer and other liquors. People like to smoke
cigars and cigarettes. People like to get tans without tan lines.
Doing these things does not hurt anyone. Thus in a country which
claims to be free, it should be legal to do these things. I recommend
that the current laws be repealed or overturned now.
Unfortunately, I have yet to be able to find a good guiding principle
for this. For instance while it is reasonable to prohibit glass on
the beach, and while it would be reasonable to prohibit heroin needles
on the beach I merely think it is unreasonable to prohibit tobacco,
and alcohol, and nakedness and that it would be unreasonable to
prohibit marijuana on the beach if marijuana were legal. But I have
yet to find a principle that works completely. It is reasonable to
restrict glass and heroin needles if they could be littered and
subsequently stepped on. But as far as cigarettes and alcohol,
marijuana, and nakedness go, the negative externalities are so small
as to make it unreasonable to prohibit them. As far as cigarettes go,
there is more smoke from a campfire, and more litter from food.
Addicts will smoke at home all the same. I do not see how restricting
cigarettes from the beach does anything. They seem to be measures of
prejudice and bigotry. Really they should consider restricting
commercial advertising of addictive substances more if they want to do
something.
