Move to block hunt for Abacha money rejected

added to the Financial Times article by Scientology that were not present
in the original. Financial Times wrote nothing about Robert Minton or IBB.
The original article is only about Abacha, a former ruler of Nigeria with
whom Bob Minton had no dealings. Here is the original, with proper
attribution.

The Home Office was yesterday given permission to co-operate with the
Nigerian government to recover more than Dollars 1bn (Pounds 600m) that
has been traced to London and linked to associates of the late General
Sani Abacha.
The High Court in London rejected an application to block co-operation
with Nigeria in the search for the Abacha money lodged by Mohammed Sani
Abacha, the former ruler's son, and Abubakar Bagudu, a businessman linked
to the family.
The court also refused a request to block assistance for the Swiss
authorities investigating the handling of assets linked to the Abachas.
If the two Nigerians had won their case, it would have weakened the
government's response to requests for help from other countries pursuing
the proceeds of crime and corruption, and could have made it harder for
the UK to co-operate in tracing assets used to finance terrorism.
Lawyers for the Abachas argued their clients had insufficient access to
the Nigerian government's letter of request to rebut the charges. They
also said the money had been paid back under a procedure that gave the two
Nigerians immunity from further claims.
However, Lord Justice Tuckey and Mr Justice Silber ruled that the Home
Secretary had acted correctly in agreeing to Nigeria's request for mutual
legal assistance, lodged in June 2000.
They said the Home Secretary "is not required to conduct a criminal trial
on paper or decide disputed questions of foreign law before making his
decision. Here the process which led to his decision was, in our judgment,
entirely fair."
Nigeria alleges more than Dollars 4bn was looted from the country under
the Abacha regime, and has made similar requests for assistance in
recovering the money to Switzerland, Liechtenstein and Luxembourg. Last
month, it won a High Court civil order to freeze accounts connected with
the Abachas and their associates at 19 UK-based banks and recover any
assets found in them.
