Gaza Still Occupied: Israeli Report

CAIRO - Israel is still occupying the Gaza Strip even after pulling
out its military forces from the impoverished coastal area, said a
report by an Israeli organization released on Thursday, January 18.
"Israel continues to control Gaza through an 'invisible hand'",
concluded the Centre for the Legal Protection of Freedom of Movement
(Gisha) in a report posted on its website.

"Israel has not relinquished control over Gaza but rather removed some
elements of control while tightening other significant controls."

Israel pulled out its occupation forces and dismantled settlements in
the Gaza Strip in September 2005 under the comatose former prime
minister Ariel Sharon's disengagement plan.

"Israel's withdrawal of settlements and its permanent military ground
installations from the Gaza Strip did not end Israeli control of Gaza
but rather changed the way in which such control is effectuated,"
asserted the Israeli group.

"But even after they leave, Israeli control over the lives of Gaza
residents remains constant.

"Gaza residents know that their ability to use electric lights, to buy
milk, or to have the garbage collected depends on decisions made by
Israel."

Gisha stressed that Israel still has tightened control over borders,
airspace, territorial water, population registry, tax system and supply
of goods in the strip.

Occupied

The Israeli group cited examples of Israel's control of all aspects of
life in the densely-packed strip.

"Israel controls movement within the Gaza Strip through sporadic troop
presence and artillery fire from positions along its borders with
Gaza," it said.

Israel is also occupying northern Gaza which it declared a no-go zone
in December 2005, added the group.

"Additional no-go zones within the Gaza Strip are occasionally declared
by Israel."

Gisha said Israel is also using the Gaza crossings to control the
movement of people and goods in and out the coastal area.

"Despite disengagement, Israel retains control over Gaza's land
crossings, including complete control over the entrance of foreigners
and imports as well as ultimate control over the entrance and exit of
all persons and goods by virtue of the ability to close all crossings
into Gaza."

Israeli internal military documents have revealed that Israel was using
the Rafah crossing to pressure the Palestinians to release a captured
soldier taken prisoner by resistance groups.

Gisha said that Israel's continual closure of the Rafah crossing,
Gaza's only gateway to the outside world, has caused the worst
humanitarian crisis in the strip.

"Israeli actions since September 2005...have contributed to an economic
and humanitarian crisis in Gaza not seen in the 38 years of Israeli
control that preceded the withdrawal of permanent ground troops.

"Israel has imposed severe restrictions on imports which have, at
various points, caused shortages of basic goods that threatened the
health and welfare of Gaza residents."

The Palestinian people have gone on the verge of starvation under a
US-led economic siege in place since the Hamas-led government came to
power, affecting livelihood in the Palestinian territories.

Paralyzing Life

The Gisha report accused Israel of blocking efforts by the Palestinian
Authority to provide assistance to ordinary people.

"Israel exercises control over the ability of the PA to provide
services to Gaza and West Bank residents and the functioning of its
governmental institutions, including by control over the transfer of
tax revenues which amount," it said.

"Israel controls the tax system in the territories of the Palestinian
Authority, with the exception of direct taxes such as income tax and
some kinds of value-added and customs taxation.

"This system affects civilian life in Gaza, including the ability of
nonprofit organizations to receive tax-exempt donations of equipment or
materials."

Israel has been withholding monthly tax revenues collected on behalf of
the PA since the new government assumed office.

Israel is also retaining control of the Palestinian population
registry.

"The definition of who is 'Palestinian' and who is a resident of Gaza
and the West Bank is controlled by the Israeli military," said Gisha.

"Even when Rafah Crossing is open, only holders of Palestinian ID cards
can enter Gaza through the crossing, therefore control over the
Palestinian Population Registry is also control over who may enter and
leave Gaza."

The report said that Israel has not permitted any additions to the
Palestinian population registry since 2000.

Israel is still the legal occupying power in Gaza, the West Bank and
Golan UNTIL a peace treaty with the hostile parties come into effect.
You don't have to have troops to be a legal occupying power. The Virgin
Island and Samoa and Guam and even Puerto Rico are still in effect
occupied since the Spanish American war. Those areas cannot do trade
or have independent foreign and military policies without the US
Congress oversight.
