For fong’s family and their attorney, I am sure they have their own
reason to file this lawsuit.
For the police, I am sure they stand by their officers’ reports.
For this pioneer press writer, we cannot assume that what he wrote is
the true fact because he simply wrote what he knew and from second
hand says.
According to this particular article, it said the gun found next to
fong’s body was dang her’s gun, which had been in police’s possession
since 2004 from a burglary. It said 10 days after the shooting, the
police, however, wrote a supplemental report claiming that the gun
recovered from the burglary was actually now not dang’s gun. By
reading this, it does sound very interesting. However, again we
cannot assume that what this article said is the true fact.
For me, I say it is highly unlikely that the gun was planted by the
police regardless. The reason is because I know for a fact that when
a gun or weapon was confiscated or found, it is kept in a secured
locker room called evidence room which is always locked that only
certain personnel has access to it. Not a single police officer is
allowed to have access to it. Not even the Chief has access to it.
Each police agency authorizes 1 or 2 staff with a certified training
to have access and can retrieve evidence in and out. All evidences
that are retrieved or removed must be authorized with 2 or more
signatures on it. If it was a plant, the officer would have to come
back to the station after the shooting and asked the authorized
personnel to retrieve the gun from the evidence room and went back to
the shooting scene and placed it there. All of this would take at
least 30-45 minutes. Now remember that in all incidents involving
shootings with injuries and death the fire and ambulance personnel
should arrived within 10-15 minutes. So as far as timing goes, it is
virtually impossible that a plant can be done.
The only way that I can think of that the police could have planted
this gun is this. the officer found the gun dropped by one of the
running boys in the street while chasing these boys and placed it next
to fong lee’s body after he shot fong to death. This is possible.
How naive of you. Did you know that word “gullible” is not in the
dictionary?
All the police have to do is provided a signed receipt that the gun
was returned to Dang Her and it was out of their possession. End of
story!
OMG - if the gun was in Fong's possession or his friends before they
were chased, how come there was no print on the gun. Fong was not
wearing gloves. And you know what? What about the cop who had the gun
from the 2004 incident, who never returned the gun, he was the first
to response to the crime scene.

This case truely disturbed me... Our Hmong brothers and sisters must
unite to help the Lee Family to fight for this case. One way or the
other the evidences were not matched.
Remember the Rodney King beating in Los Angeles. The whole town got
burned and it was justified. People's power can get these ugly cops
behind bar for a long time... Don't target those cops only... get
their dirty bosses down too...

1. when we met with the police chief, there was no mention that a gun
was recovered at the scene. there was only a mention that it looks
like fong lee was reaching for his gun;
2. the chief told us not to talk to the media after our briefing
because the case was under investigation. as soon as we left the
chief's office, he went to the media and told his version of the
story, even after we all agreed to not talk to the media. this to me
was a violation of trust. why was he so eager to talk to the media
after our conversation? did he have something to hide? obviously
from this news report, it seems like it.
3. instead of notifying the family about mr. fong lee's death, they
went to two organizations. it took them more than 24 hours to notify
the family members about their son's death. what took them so long to
do so? what were the intent of these two organizations? what was the
intent of the police department? the rationale that they gave us was
that they did not know who fong lee was. and yet, they were able to
trace his history? fishy there.
anyway, we cannot sue the police department. only the family do so.
we can only look out for the interest of the entire community.
however, we needed the family's cooperation, access to their
investigative report so that we can move ahead with our complaint.
when we did not get the cooperation from their clan representative, we
then decided to drop the case.
you may wonder why i was involved. there was a community meeting
convened by the Hmong 18 Council clan. I was invited to the meeting.
everyone at the meeting asked me to be the spokesperson. the family
also asked me to be involved. as such, i was appointed by the
committee to get involve after pleading from those who were there and
the 18 council president. what i did was:
1. held a press conference in minneapolis city hall;
2. file a human/civil right violation complaint against the
minneapolis police department;
other members organized marches, protests and etc.

The key points are these:
1. the video tape clearly showed there is no gun in fong’s hand
2. the police initial report stated there is no fong’s finger print on
the gun
3. 10 days after the shooting the police wrote a supplemental report
that contradicted the initial report about the gun that was recovered
from the burglary.
4. the gun found next to fong’s body. How did it get there?
I think these are the key points that will put the Minneapolis
department on the line this time. We will just have to wait and see.
