CALGARY — New rules to stop the “dirty work” some employment agencies engage in
to bring temporary foreign workers to Alberta were rolled out by the provincial
government on Thursday.

More than 58,000 temporary foreign workers (TFWs) help to keep Alberta’s steady
economy humming, and Service Alberta Minister Manmeet Bhullar said he knows some
unscrupulous agencies are preying on the foreign labourers’ dreams of becoming
permanent residents here.

“There’s a lot of heartbreaking stories out there,” Bhullar said at a news
conference announcing the new rules in Calgary on Thursday.

Alberta immigration agencies have long complained that foreign workers or their
families have been billed large and illegal “recruitment” fees for entry into
the country or are forced to pay for English lessons or other career services
they don’t need.

“We’ve closed a whole bunch of loopholes and made it much more difficult for
people to evade the law,” the minister said.

Bhullar said most of the more than 500 employment agencies working in the
province today follow the rules. But there are some who “have agents in many
foreign jurisdictions that often do the dirty work for the agencies here.”

His department will add a number of rules to the Employment Agency Business
Licensing Agreement regulation, which prohibits charging workers a fee for
finding them a job (employers must pay that cost).

Amendments to the regulation will explicitly state it’s illegal to mislead
temporary foreign workers about their chances of becoming a Canadian citizen, or
to intimidate or threaten individuals seeking work.

Bhullar said employment agencies will have to keep better records of their
transactions and register all their agents here and abroad.

The minister said if companies are judged by Service Alberta to have a spotty
record, they’ll be forced to post a security bond — to be used should they be
ordered to pay the money back.

The changes come into effect on Sept. 1.

Temporary foreign workers are allowed into the country at the request of an
employer unable find a Canadian worker to do a specific job. Even with the
economic slowdown, the number of foreign workers living in the province has
increased by 20,000 since 2007.

Liberal Calgary-McCall MLA Darshan Kang said the government’s changes are a good
first step but they don’t go far enough.

He said the government must launch more prosecutions of companies that break the
rules: “This government won’t walk the talk. This is just the tip of the
iceberg.”

However a spokesman for the Association of Canadian Search, Employment and
Staffing Services, which represents the staffing industry, said other provinces
should follow Alberta’s lead.

“We feel this is one of the best steps we could see happening in terms of new
rules and an ability to differentiate between the organizations that are doing
great work and the organizations that are taking advantage of vulnerable
workers,” said vice-president Randy Upright.
