District Judge Edward Cashman vowed Tuesday to uphold the 60-day minimum
prison sentence he imposed on a child molester convicted of having
frequent sexual contact with a young girl during a four-year span
despite withering criticism from the public, politicians and the media.
“I am aware that the intensity of some public criticism may shorten my
judicial career,” the judge wrote in a nine-page ruling supporting the
sentence for 34-year-old Mark Hulett. “To change my decision now,
however, simply because of some negative sentiment, would be wrong. I
owe it to the judiciary and to my own conscience to maintain a stand
that I believe is the best possible option in a very difficult
situation.”
The furor arose last week, when Cashman gave Hulett the short minimum
sentence, followed by a lengthy term — possibly life — of state
supervision and sex-offender treatment in the community.
Hulett pleaded guilty in August to charges stemming from the assaults on
the girl, a friend’s daughter, from the time she was 6 until she turned
10 in April.
Cashman also took aim at the state Corrections Department. Although at
times he praised Corrections’ sex-offender treatment program, Cashman
wrote that the department’s refusal to offer counseling to Hulett while
imprisoned was the impetus behind the short term of incarceration.
“The Corrections Department presents the court with a sentencing
dilemma,” Cashman wrote. “It requires the court to choose between two
less-than-ideal options. One option enhances the long-term risk to
public safety, due to the future release of a hardened, untreated sex
offender. This person would endanger our children and grandchildren.
“In order to avoid that risk,” Cashman continued, “the other option
would impose a low minimum on a lengthy incarcerative sentence. This
would ensure treatment occurs in a timely manner.”
