Nearly 40 years after his death, Ernesto "Che" Guevara is in the news
again. He's the subject of a new film entitled The Motorcycle Diaries about
his coming of age during a trek through South America. The movie was
screened at the Sundance Film Festival, where it reportedly received several
standing ovations. Among the luminaries in attendance was former Vice
President Al Gore.
Che Guevara remains an icon throughout much of America, and, indeed,
the world. His surname is superfluous. Everyone knows Che! His image adorns
college dormitories and bookstores; Che t-shirts are ubiquitous at every
antiwar march and anti-globalization protest. New books about the life of
the "revolutionary" are published every year.
Throughout much of the '60s and '70s, Che was the archetype of
rebellion against repressive authority. The hagiology portrays him as a
selfless physician born to wealth, who heroically spurned the corrupt
oligarchy that supported his bourgeois lifestyle, and who then became a
guerilla fighting for the downtrodden. Scores of plays and seminars are a
testament to the esteem in which he is held by bien pensants. All of this
for a delusional, egocentric thug who delighted in summarily executing
anyone he deemed an "enemy of the revolution." But at least he was
photogenic.
In contrast, only a handful of Americans have ever heard of Dr. Oscar
Elias Biscet. Like Che, Biscet is a physician. He's at least as photogenic.
And his life story is arguably more compelling and inarguably more
honorable. But don't expect posters of Biscet to grace campus bookstores.
There probably won't be any movies about him, and definitely none attended
by the glitterati. No college symposia will be dedicated to Biscet's
political philosophy.
Biscet's story is a bit inconvenient for the sophisticates who embrace
the romantic vision of Castro's valiant struggle on behalf of third-world
victims of capitalist exploitation. The journalists, entertainers,
left-leaning politicians, and civil-rights activists who are treated by
Castro to guided tours of the Cuban "paradise" never hear of Biscet, or of
the thousands like him who are brutalized in Castro's prisons for having the
audacity to desire freedom of speech, assembly, and religion; the right to
own property or perhaps start a business; the right to be free from the
constant threat of arbitrary persecution - in short, for wanting freedom
from the tyranny Che helped create.
Dr. Biscet is serving a 25-year sentence for supporting human rights
by peacefully staging a hunger strike in his home. He's a principal of the
Varela Project, an initiative to secure basic human rights for the Cuban
people.
This is Biscet's second stint in prison. He was initially released on
October 31, 2002, after having served three years for the crime of
"disrespect," only to be arrested again barely a month later.
Reliable information on Biscet's status is difficult to obtain. Castro
isn't eager to publicize his dungeons. What details emerge come primarily
from Biscet's wife, other prisoners, and his brief yet powerful letters
smuggled from prison, the combined texts of which evoke Rev. Martin Luther
King's "Letter from a Birmingham Jail," though with descriptions of
appalling degradation and brutality.
Dr. Biscet has seen his wife twice in the last ten months. Her most
recent visit, on December 30, lasted only 15 minutes.
Biscet's physical condition is in dangerous decline. He's rail thin,
having lost an estimated 40 pounds. He suffers from severe hypertension. In
addition to being malnourished, he has lost several teeth during his latest
confinement.
Biscet's prison cell is the stuff of a Victor Hugo nightmare; tiny,
filthy, and shared with an almost uncontrollably violent cellmate. He has no
windows and hasn't seen sunlight in weeks. He's afforded no medicines or
toiletries. Other than the two visits from his wife, he's permitted no
visitors, correspondence, or other reading materials. Nonetheless, he
inspires others with his repeated acts of defiance against his persecutors.
The probability that Biscet will survive his sentence isn't great. He
has but two avenues of hope.
The first is liberation after Castro's death. Speculation about
Castro's imminent demise swirled in the last two weeks after the visiting
mayor of Bogota, Luis Eduardo Garzon, described Castro as appearing gravely
ill. But while Castro is 77 years old and life-insurance agents aren't
exactly rushing to sell him a policy, semiannual reports of Castro on his
deathbed have been coming out of Cuba for more than 20 years. Moreover,
there's no guarantee Cuba will turn into a democratic republic immediately
upon Castro's death.
The other hope is perhaps even more farfetched - that widespread
publicity of Biscet's plight and that of other political prisoners will
shame the dictator into releasing him. Castro is not known for yielding to
this kind of pressure, although it's conceivable that after a period of
protest Biscet could be released without fanfare.
Regardless, the unfortunate reality is that Dr. Biscet will never
receive the kind of coverage that would cause Castro even the slightest
discomfort. The media outlets with the capacity to generate the requisite
publicity seem more intent on focusing on the Bush administration's
purported lack of "balance" and "nuance" toward Castro's regime. And
human-rights activists seem more occupied with the plight of enemy
combatants who daily profess a desire to obliterate anything and everything
American (and whose own accommodations on the Caribbean island are, in
comparison to Biscet's, opulent) than with a humble but charismatic doctor
who has professed nothing but admiration for American democracy.
Consequently, the odds are that a true champion for liberty will spend
his remaining days wasting away in unspeakable privation and pain. In the
meantime, the memory of Castro's homicidal lieutenant will be cheered by the
elite for years to come. After all, he looked really cool in a beret.

Now, don't take my word for it. Back in 1968, during the Democratic
National Convention in Chicago, the guy was also called a crypto nazi by
none other than the great Author Gore Vidal, in front of the cameras and in
front of tens of millions of people watching the debate. Why Gore Vidal
came to the same conclusion? You read Buckley's books and articles, read it
between the lines, and maybe you might end up arriving at the same

Grecia niega el visado a Fidel Castro para los Juegos Olímpicos
Atenas.- El presidente Cubano, Fidel Castro, anunció que Grecia le negó el
visado para estar presente en los Juegos Olímpicos de Atenas 2004, y aseguró
sentirse muy apenado, reseñó Dpa.
"Ustedes han venido a mi país, pero yo no puedo ir a los Juegos Olímpicos
del suyo porque carezco de visado", dijo Castro a los periodistas griegos
presentes en La Habana con ocasión de la visita del patriarca ortodoxo
Bartolomeo I.
Según publica hoy la agencia griega ANA, Castro se mostró "muy triste" por
esta situación.
A principios de año, el primer ministro griego Kostas Simitis cursó
invitaciones a los jefes de Estado de los países más importantes del mundo
para los Juegos Olímpicos que comienzan el 13 de agosto. Castro no figuraba
en esa lista.
Atenas se atiene al respecto a las decisiones de la Unión Europea (UE).
Debido a la violación de los Derechos Humanos en Cuba, la UE acordó evitar
contactos oficiales con el gobierno de La Habana.

The remarks of Raúl Taleb, Argentina's ambassador in Havana, are an insult
to Cubans who suffer human-rights abuse first hand. "Human rights are not
violated in Cuba, at least not more or less than in other countries," the
ambassador said last week to La Nación, a Buenos Aires daily. "Could freedom
of the press be restricted? Yes. Could the existence of a single party mean
that its system cannot be called democratic? It's possible. But that's a
decision supported by a large sector of the population that is pleased with
the '59 revolution."

Dissidents railroaded
Ms. Reyes didn't mince words. Mr. Taleb "doesn't know my country. He knows
the elites," she said. "He drives through the streets in his air-conditioned
car," moving in the rarefied world of foreign diplomats. "He can talk about
that Cuba, a country that I don't know."
In October, six months after her husband and 74 other political prisoners
were railroaded into prison for lending books and for other ''subversive''
activities, Argentine Foreign Minister Rafael Bielsa visited Havana. He
rebuffed a request to meet Ms. Reyes and other wives. Instead, Mr. Bielsa
strolled Havana with his Cuban counterpart, sightseeing and sampling ice
cream. Under President Néstor Kirchner, Argentina returned to the morally
repugnant see-no-evil approach to Cuba that is popular in the region.
The Argentines, as Ms. Reyes suggested, need only read her husband's
indictment to see the lies. What dangerous weapons did state security
confiscate? Poetry books, press clips, a radio, a recorder, a laptop, audio
and video cassettes with "information destined to subvert the economic,
political and social system of Cuba." What bunk. Truth is the weapon feared
most by Cuba's regime.
Free in spirit
"I don't even have the right of reply," Ms. Reyes said. "I would like to
have my comments published in my own country." But Cuba's state-owned media
refuse her submissions. "Even this conversation is tapped," she said. "How
can Mr. Taleb say that human rights aren't violated when I am not even
permitted to visit my son in Miami?
"`Raúl is in a small cell; I am in a large one." Yet even in prison, Mr.
Rivero's spirit remains free. "I think of you often and write a lot -- and
excellent poetry," he wrote to Ms. Reyes. "A poetry with great interior
rhythm, freed from hate and earthly foolishness, clean and serene, almost
celestial in human themes, not thinking of the verse as a weapon, rather a
frozen emotion, love isolated, an instant of life that one has been able to

Iraq-Cuba axis
A senior Defense Department official tells us one of the alarming
after-action intelligence reports that reached the Pentagon is that the
communist government of Cuba shared intelligence on the United States with
Saddam Hussein's regime.
The reports stated that Cuban intelligence, which is known to have
extensive "coverage" of U.S. military bases, supplied information to
Saddam's intelligence service on the movement of troops and other military
activities.
The intelligence ties are believed to be an offshoot of Cuba's covert
oil-purchasing arrangement with Iraq under Saddam. Those deals have been
under way since the late 1990s and involve oil tankers that were sent to
Mexico. The oil then was pumped from the tankers to smaller boats for
delivery to Cuba.
The intelligence sharing also comes amid reports from Cuban exiles that
Cuba became a safe haven for fleeing Iraqi government officials following
the U.S.-led invasion.
Asked about the Cuba-Iraq intelligence-sharing, a second U.S. official
said the CIA had no information about it.
Match game
The world's most sought-after terrorist may be caught thanks to common
matchbooks.
The State Department's Bureau of Diplomatic Security is circulating
thousands of the most-wanted matchbooks in Pakistan and Afghanistan. The
green books feature a picture of Osama bin Laden and, in Arabic, information
on why he is sought, the reward of up to $25 million and a 1-800-number to
report a tip.
Bin Laden is believed to be moving around in the no-man's-land tribal
areas of Pakistan and Afghanistan. Like the tip that resulted in the Dec. 13
capture of former Iraqi dictator Saddam Hussein, the Bush administration is
hoping some local will read the matchbook and decide to pinpoint the terror
master's location.
Open the book and the recipient gets 30 matches and this passage: "Osama
bin Laden has been indicted for the murders of 220 innocent civilians in
Kenya and Tanzania on Aug. 7, 1998. The U.S. government is offering a reward
of up to $25 million for information leading to the arrest and conviction in
any country of bin Laden. Persons providing such information may be eligible
for reward up to $25 million, protection of their identity and possible
relocation."
The book also instructs, "close covering before striking."
Handing out matches seems like an ingenious way to catch a criminal. But
in Afghanistan, a State Department official has objected to the handout,
according to a joint investigation by the House International Relations
Committee and the Appropriations subcommittee on commerce, justice, state
and judiciary.
Hyde hearings
Months before the U.S. Navy seized al Qaeda-linked boats carrying
heroin, Rep. Henry J. Hyde, Illinois Republican, was warning the
administration of ties between drug trafficking and terrorists, including
Osama bin Laden.
Mr. Hyde, chairman of the House International Relations Committee, sent
a letter to Defense Secretary Donald H. Rumsfeld Oct. 30 suggesting the
Pentagon become more active in counternarcotics, especially in Afghanistan.
There, a burgeoning poppy crop is producing huge quantities of heroin whose
proceeds are diverted to bin Laden's al Qaeda network, U.S. officials say.
"I am growing increasingly concerned about the reported role which
illicit drugs play in financing terrorism," Mr. Hyde said in his letter to
Mr. Rumsfeld. "As you know, reports indicate that the proceeds from illegal
drug trafficking are supporting many of the foreign terrorist organizations
which the Defense Department and law enforcement agencies fight every day
around the world."
The congressman added, "A greater role by the Defense Department may be
called for. In Afghanistan, for example, military intelligence should work
cooperatively with the [Drug Enforcement Administration] to identify and
destroy the opium depots and heroin production labs in that country when the
opportunity presents itself to the military."
The staff of Mr. Hyde's committee and of the Appropriations subcommittee
on commerce, justice, state and judiciary recently completed a joint,
five-day fact-finding trip to Pakistan and Afghanistan. The investigators
interviewed sources who said bin Laden's group is now garnering millions of
dollars from heroin after the West cut off some of its traditional sources
of money.
Mr. Hyde now plans committee hearings to expose the trip's findings. He
also will summon Bush administration officials to get their assessment of
the bin Laden drug connection.
Next chairman
Republicans are starting to whisper about who is going to be the next
chairman of the Senate Armed Services Committee if the GOP retains control
of the Senate in 2006.
Sen. John W. Warner, Virginia Republican and the current chairman, is
term-limited and must step down after the 2006 elections. GOP Senate rules
limit the position of chairman to six years.
The next in line is Sen. John McCain, Arizona Republican. That's where
the whispering comes in.
Some in the Senate are wondering whether the Republican caucus will
endorse Mr. McCain in light of the fact he is "anti-pork" -- that he deems a
number of military projects for home-state senators as superfluous. The
other mark against him is that as an anti-Republican Republican, he has
voted against the Republican leadership on key issues, such as tax cuts and
President Bush's Medicare prescription bill.
Then, there is a chance Republicans will remove the term-limit rule.
Some wonder whether it is an inducement for safe-seat senators to retire
after running out of committees to chair. The Democrats have no such
term-limit rule.
Baghdad story
One of the Iraqi translators working for the Coalition Provisional
Authority (CPA) lucked out. The translator came in to work on Tuesday with a
special gift for Dan Sudnick, a CPA senior adviser for communications.
The female translator was crying as she explained how grateful she was
that Mr. Sudnick had encouraged her to take Sunday off from work (the normal
Iraqi day off is Friday).
As a result, she stayed home and was not standing in line when a
devastating car bomb exploded outside the entrance to CPA headquarters that
day. The bomb killed 20 persons and injured 60, many of them friends. For
the Iraqi workers, the jobs at CPA office, located in a former Saddam
Hussein palace on the Tigris River, are the only sources of income for their
families.
"Our translator explained that she too was very poor and was supporting
her family, but she presented a beautiful hand-carved box to Mr. Sudnick and
told him it was something from her home that she had selected to give to
him, something beautiful and precious, in gratitude for the kindness he
consistently showed to her, that ultimately saved her life," said Bonnie
Carroll, a reserve Air Force major and Veterans Affairs employee on loan to
the Pentagon.
"We all cried and hugged, and were one family mourning the losses and
being thankful for those who were spared."
Maj. Carroll continued: "Each day here in Iraq is a triumph of heroes
who are coming forward to rebuild their country. I am in a constant state of
amazement at their courage and strength and commitment, even if it means
their lives, for this powerful cause."

The official visit of Patriarch of Constantinople to Estonia, which
lasted from October 26 to November 1, is over. The Ecumenical Patriarch was
accompanied by Archbishop of Carelia and all Finland John, the hierarchs and
clergy of the Finnish diocese of the Constantinople Patriarchate. We should
remind that, regardless of Church canons, Patriarch Bartholomew had notified
neither Patriarch of Moscow and All Russia Aleksy, nor Archbishop Kornily of
Tallin and all Estonia of his intention to visit Estonia, which is the
canonical territory of the Moscow Patriarchate.
An unprecedented action was timed to the visit of Patriarch
Bartholomew to Estonia. The Constantinople Patriarchate had issued an Act of
canonization of Bishop Platon of Revel, Estonian hierarch of the Russian
Orthodox Church, who had been previously glorified according to all canons
of the Russian Orthodox Church. This August the Jubilee Archbishops' Council
of the Russian Orthodox Church enacted the glorification of Bishop Platon of
Revel as a New Martyr. The order of canonization was solemnly performed in
Christ the Saviour Cathedral in Moscow on 20 August 2000, where the
delegation of the Constantinople Patriarchate was present. As it is known,
Bishop Platon of Revel was martyred on 24 January 1919, being the vicar of
the diocese of Riga of the Russian Orthodox Church and having never been the
cleric of the Constantinople Patriarchate.
Before the visit of Patriarch Bartholomew to Estonia the Department
for External Church Relations of the Moscow Patriarchate held negotiations
with the plenipotentiaries of the Constantinople Patriarchate and the
Government of Estonia, and made efforts at putting an end to the four-year
opposition between the jurisdictions of the two Churches in Estonia through
the approaching visit of the Patriarch. It could have been realized by the
joint declaration of the Heads of the two Orthodox jurisdictions in Estonia,
that would have stated reconciliation between all the Orthodox and the
forthcoming restoration of the equal rights for all the Orthodox
congregations, including the right of historical church property. However
the Constantinople side refused to give the legal rights of historical
church property, which it had previously obtained, back to the parishes of
the Estonian Orthodox Church of the Moscow Patriarchate, which had possessed
this property (18 churches and administrative premises) for centuries and
still uses it at present.
In the course of his visit to Estonia at the official meetings and in
the media Patriarch Bartholomew proclaimed the following:
1.. The agreements, which were concluded by the two Churches
regarding the Church position in Estonia in Zurich in May 1996, are wrongly
interpreted by the Russian Church, they can't be interpreted as 'the
decision which allows two parallel jurisdictions exist in Estonia.'
2.. The parishes within jurisdiction of the Moscow Patriarchate in
Estonia must be run by their Local Church in the form of
'exarchia'(representations) or metokhions.
3.. There can be only one Metropolitan or Archbishop in Estonia
titled 'of all Estonia', and there can be an 'Exarch'(representative)
affiliated to him, with the parishes directed by the Russian Orthodox
Church.
4.. 'The Moscow Patriarchate has no grounds for seeking the right of
succession in Estonia.'
5.. 'Estonian Apostolic Orthodox Church of the Moscow Patriarchate
is the rightful successor in Estonia, and it carries on the administrative
supervision of the Orthodox parishes on the whole territory of the country.'
6.. 'The Moscow Patriarchate must dismiss Archbishop Kornily from
his post...'
The Estonian Orthodox Church of the Moscow Patriarchate which numbers
more than 100,000 of believers, didn't take part in canonical communion with
the delegation headed by Patriarch Bartholomew, believing him to be
responsible for the schism of the Orthodox society in Estonia, sharpening
ethnic division in the country, as Patriarch Bartholomew and heading the
Constantinople structure in Estonia Metropolitan Stephanos had showed
obvious neglectfulness of the suggested peacemaking proposals.
The Orthodox members of Parliament of the Republic of Estonia have
testified that 'the expectations of believers that the visit of Patriarch

-El agro-sindicalismo en Cuba-
En 1982 salieron de Cuba, de manera simultánea, noticias confusas acerca de
síntomas de rebeldía en el seno de las masas trabajadoras, fundamentalmente
campesinas. Un conato de huelga en el central Abraham Lincoln y la detención
de una veintena de activistas de un movimiento agrario: El Grupo Zapata. Se
les acusaba de haber realizado varios sabotajes y se habló incluso, del
intento de crear una organización sindical independiente.
Cinco hombres fueron condenados a muerte, y una mujer, Caridad Pavón (La
Gallega), líder feminista del grupo, no pudo sobrevivir a las torturas en
Villa Marista (lugar habitado por el Departamento de Seguridad del Estado,
G-2, para realizar interrogatorios); su misteriosa muerte fue calificada
por las autoridades descaradamente de "suicidio".
Una fuerte campaña internacional salva de la muerte por fusilamiento a los
cinco activistas, quienes sin embargo, fueron mantenidos en severa
incomunicación durante varios años, y aún hoy, permanece en el tenebroso
"Rectángulo de la Muerte" de la prisión Combinado del Este, en la provincia
de La Habana, Angel Donato Martínez, uno de los líderes anarco-sindicalistas
del movimiento Zapata.
Retomando el legado ideológico del magonismo-zapatismo, fue inspirado este
movimiento agro-sindicalista, autogestionario, con los objetivos de
reivindicar a la clase obrero-campesina por medio de la toma de la tierra y
de la maquinaria, expropiando al Estado (único patrón y propietario
monopolista de toda la tierra y de todos los medios de producción bajo el
capitalismo de Estado).
Consecuentemente a sus ideales, estos activistas agro-sindicalistas
intentaban realizar contactos con grupos similares en América Latina y otras
partes del mundo, con los mismos fines: la democracia directa de los
trabajadores.
La corta vida del movimiento (en la calle, porque aún se mantiene vivo tras
los muros de la prisión) no le permitió desarrollarse hasta alcanzar -lo que
ellos denominan- un movimiento de masas auténticamente revolucionario. No se
materializaron los contactos, no se desarrolló la lucha, pero si quedo
plasmado en el proceso histórico cubano, una vez más, la necesidad de una
verdadera Revolución dentro de la llamada Revolución. Este planteamiento,
que tan frecuentemente nos llega procedente de la juventud en la isla
(quienes día a día intensifican más la lucha revolucionaria para sacudirse a
los burgueses de la nueva clase dominante) los atemoriza, ya que esto
significa el fin de los privilegios de la elite burguesa que en nombre de
la clase trabajadora se les ha encaramado sobre sus espaldas, mediante una
brutal maquinaria represiva que no escatima en sentenciar, encarcelar o
fusilar a todo aquel que disienta de ella.

Estados Unidos condena la continua detención de defensores cubanos de los
derechos humanos
En marzo último el gobierno cubano declaró culpables, mediante acusaciones
fraguadas, a 75 periodistas, bibliotecarios y defensores de los derechos
humanos, y los condenó a sentencias de prisión injustas -- de una duración
media de 20 años -- por intentar ejercer sus derechos fundamentales, que
gozan de la protección internacional. Estados Unidos condena la detención
continua e injusta de estas personas y reclama su inmediata liberación.
Como injusticia adicional, el gobierno cubano está persiguiendo
sistemáticamente a estas personas. José Daniel García, miembro del
Movimiento Cristiano de Liberación, sentenciado a 28 años por el papel que

compromiso con el empleo de medios no violentos para lograr el cambio, fue
arrestado en diciembre de 2002 por tratar de enseñar a otros acerca de las
prácticas internacionales de los derechos humanos. Tampoco debemos olvidar a
presos políticos que han sufrido mucho tiempo, como Francisco Chaviano,
defensor de las reformas democráticas pacíficas, que en 1994 fue sentenciado
a 15 años de prisión por revelar que un miembro de su organización era, en
realidad, un agente del gobierno.

Las ultimas construcciones habitacionales fueron las de la Habana del Este,
comenzadas durante el gobierno de Fulgencio Batista en 1957. Control de
Viviendas se refiere por lo tanto a las habitaciones que habia cuando Cuba
tenia 6,7 millones de habitantes. Hoy son casi doce millones. Confirma asi
el regimen que mas de 8 millones de Cubanos no tienen una vivienda adecuada.
La situacion no tiene solucion debido a la prohibicion de la propiedad
privada, pues el gobierno no construye ni repara viviendas y no permite al
ciudadano comprar materiales de construccion, teniendo que comprarlo a
quienes lo roban o robarlos ellos mismos.
En la actualidad LOS UNICOS que son propietarios de vivienda son aquellos
que ya eran dueños de la misma antes de la toma del Poder por Castro en 1959
y sus herederos, si continuaron residiendo sin interrupcion en la misma. A
continuacion desde Cuba nos envian las ultimas disposiciones "legales" sobre
la vivienda en Cuba.
¿Quién posee las viviendas en Cuba?

La legislación encargada de regular la propiedad inmobiliaria urbana en Cuba
es la Ley General de la Vivienda (número 65 de 1988) y un gran número de
disposiciones complementarias, que luego de reconocer caso a caso los
"derechos de los propietarios", establecen imperativamente un listado
excesivo de limitaciones a los mismos, reduciendo la supuesta propiedad
individual de los cubanos sobre viviendas y terrenos a una hoja de papel que
no es eficaz sin el permiso de las sacrosantas instituciones
administrativas.
Para disponer del "derecho de propiedad", ya sea durante la vida o para
después de la muerte, gratuita u onerosamente, la intervención del estado se
hace patente, imponiendo requisitos y condiciones, prohibiendo,
restringiendo.
No le está permitido a ningún cubano vivir en más de una vivienda en
"propiedad", a excepción del caso en que, además del espacio habitacional de
residencia permanente, la persona "posea" otra casa en zona de descanso o
veraneo. Particularicemos en algunos de los teóricamente llamados ''actos de
disposición'' y en otros casos de interés.
Compraventa de viviendas. Antes de la modificación legal dispuesta por el
Decreto 233 del 2003, cuando el "propietario" deseaba vender su casa debía
ofrecérsela primeramente al estado, quien tenía derecho de ''tanteo'', es
decir, de adquisición preferente frente a cualquier otro comprador, al
precio establecido en la tasación oficial que el mismo disponga, que por
supuesto es ínfimo en comparación con el valor real del bien. Sólo si el
estado rehusaba comprar podía un comprador particular consumar la venta.
Esta hipótesis era sencillamente imposible pues el estado, si no puede
decirse que estará siempre interesado en el inmueble en cuestión, lo está en
que ninguna mano privada reciba beneficios económicos por este legítimo y
elemental acto de dominio. El tanteo era sólo un mecanismo solapado que
ocultaba la prohibición de venta de las casas entre particulares.
Actualmente se ha eliminado esta sutil forma de legitimar lo que en sí mismo
es una completa violación al derecho a la propiedad, derecho humano
reconocido desde la Declaración francesa de los Derechos del Hombre y del
Ciudadano de 1789. (Y la Declaracion de Los Derechos Humanos de las Naciones
Unidas en 1948). Ahora resulta todo más simple y claro: no podrá venderse
la vivienda personal si no es a favor del estado. La modificación no aporta
nada nuevo a la realidad cotidiana de los cubanos, sólo constituye una
muestra más palpable y evidente de represión y menosprecio a los derechos
individuales.
Permuta de viviendas. Para intercambiar la propiedad sobre las viviendas,
ambas partes deberán obtener como requisito previo e imprescindible una
resolución de la Dirección Municipal de la Vivienda (órgano administrativo
que controla estas operaciones a nivel municipal) que apruebe el acto. Para
ello se radica un expediente y se sigue todo un proceso de inspecciones,
supervisiones, deliberaciones y todo tipo de pesquisas sobre los reales
motivos que impulsan a las partes a llevar a cabo la permuta. Sólo cuando no
quedan dudas de la licitud del caso (pues se entenderá que luego de la
prohibición de venta, los particulares acuden a la permuta para legalizar de
algún modo el acto verdaderamente querido), se otorga la referida
aprobación.
Donación de viviendas. Igualmente necesario resulta recibir la autorización
al final de un engorroso procedimiento administrativo en la Dirección
Municipal de la Vivienda. Esta sólo tendrá lugar si el beneficiario es
descendiente, ascendiente, hermano, tío, sobrino, cónyuge o ex cónyuge del
propietario; siempre en estos últimos casos, se requiere que el matrimonio
haya durado al menos dos años o se hayan procreado hijos.
Si el propietario desea desprenderse gratuitamente de su vivienda a favor de
un extraño, éste deberá haber convivido como mínimo diez años antes de la
donación en el inmueble objeto de la misma. El altruismo, como se ve, es
siempre mal interpretado, más bien pisoteado como virtud del ciudadano
cubano, controlado y fiscalizado por el estado cubano.
La herencia de la vivienda. En este punto, la legislación alcanza niveles
insospechados de extravagancia. El propietario podrá testar sobre su
vivienda, pero a su muerte, el beneficiado en testamento sólo podrá
adquirirla si:
• La vivienda quedare vacía. En caso contrario, la propiedad pasa al estado,
pudiendo éste conferírsela a quienes justifiquen haberla estado conviviendo
durante cinco años antes de la muerte (en caso de parientes hasta el cuarto
grado de consanguinidad); o diez años en los demás casos.
• Estuviere el favorecido ocupándola.
Si, no obstante, la vivienda fuere un inmueble de grandes dimensiones u
otros que pueden ser de interés público (en esta pequeña palabra se resumen
todos) y el heredero beneficiario no fuera de los parientes llamados por el
código civil a la herencia (descendientes, ascendientes, cónyuge, hermanos y
sobrinos), el estado podrá adquirir para sí el inmueble y asignar otra
vivienda al favorecido, que será más bien el perjudicado. Se omite toda
referencia a la lógica indemnización por la diferencia de precios entre las
dos casas. Con esto trata de evitarse la posible compraventa de viviendas y
que se beneficien aquellas personas no familiares que se dediquen a cuidar a
los propietarios cuando llegan a la vejez.
Pero, ¿de qué forma puede un cubano resolver su necesidad habitacional? ¿Y
qué intención de lucrar o especular tiene, por ejemplo, un matrimonio que
atiende a un anciano durante sus últimos años, sacrificando tiempo precioso
de su vida? Si el propietario ha muerto sin otorgar testamento, tendrán
derecho a la vivienda aquéllos que la estuvieren ocupando durante cinco años
antes del fallecimiento en caso de ex cónyuges y familiares hasta el cuarto
grado de consanguinidad; exigiéndose diez años en los demás casos. Cuando no
se cumplan estrictamente los requisitos establecidos, los ocupantes serán
tachados de ilegales y deberán abandonar forzosamente el inmueble.
Después de conocer estos breves ejemplos, la pregunta es cómo es posible
sobrevivir en este régimen de opresión y absolutismo que lleva a un
desconocimiento de los más elementales derechos y libertades del ciudadano.
Quizá la prohibición de venta de la vivienda sea el pecado original que
motive el uso de las permutas, donaciones y testamentos como medios de
encubrir una operación de cambio de bien por precio. Es la ley estimulando
su propia burla, el fraude de los ciudadanos y la creciente corrupción de
funcionarios públicos, pues mientras más difícil resulte la operación, mayor
será el número de los que participan en las ganancias.
Sépase que el cubano medio que en estas circunstancias decide desprenderse
de un bien tan preciado como lo es la vivienda personal, vendiéndola a otro,
no lo hace para especular o acaparar, sino por razones de apremiante
necesidad de dinero. Aquél que compra, después de mucho esfuerzo y
privaciones para alcanzar la suma requerida, no lo hace para lucrar,
explotar o comercializar con ella, sino porque necesita un lugar adecuado
donde vivir. Las personas que emplean años de su vida cuidando ancianos
desvalidos, con la esperanza de tener un espacio propio algún día, presentan
un grave problema habitacional. ¿Dónde está, pues, el interés público?
¿Acaso no debe estar del lado del necesitado?
