[Daruliftaa.Camperdown]

Question

One of the film producers want to be tenant of my flat. He may keep his things which could be use for  making film. So it is allowed to rent the flat to this person.

I am in aboard, my uncle asks me whether to give him flat on rent or not, I replied not to give. After some days my uncle told me that he already gives the flat on rent to the producer and took 2 month advance.

In this case , I will be a sin person . if produce using my flat and keeping film making material in my flat. Please reply me as soon as possible.

 

Answer

 

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatuh

 

It will be permissible to lease the flat to the film producer. You will not be sinful in doing so as the tenant has hired the flat based on residing in it and not to produce films.

 

وَإِذَا اسْتَأْجَرَ الذِّمِّيُّ مِنْ الْمُسْلِمِ دَارًا يَسْكُنُهَا فَلَا بَأْسَ بِذَلِكَ ، وَإِنْ شَرِبَ فِيهَا الْخَمْرَ أَوْ عَبَدَ فِيهَا الصَّلِيبَ أَوْ أَدْخَلَ فِيهَا الْخَنَازِيرَ وَلَمْ يَلْحَقْ الْمُسْلِمَ فِي ذَلِكَ بَأْسٌ لِأَنَّ الْمُسْلِمَ لَا يُؤَاجِرُهَا لِذَلِكَ إنَّمَا آجَرَهَا لِلسُّكْنَى .
