Just thought you all should know that the IRS is fighting my 2009 EV Tax
Deduction.  (Form 8910)
Their argument seems to be that even "Conversions" must have a
Manufacturers Certification to be allowed.
This pretty much drops the deduction for Do It Yourself conversions.

I'm having "fun" now digging through as many other sources of info as I
can to get clarifications on the rules.
If anybody has any good sources of info, I'd love to see them.

Hi John,   not a happy outcome.

For the Government to deal fairly with tax payers, tax payers should not need legal representation.  Without an attorney you can petition for a full statement of the applicable IRS legislation, policies and rule making.  They will not be able to enforce judgment based on rules levied last week, only on rules enacted and available to you prior to the conversion.  

I would be interested in the certification authority that the IRS acknowledges and accepts.

We too have been burned by the IRS and are having our 2009 NEW Toyota Prius
with A123 Systems' Hymotion upgrade disallowed (& having to pay back $3000
plus interest).  If any one out there knows how we can beat this it would be
MUCH appreciated.  We followed all the rules but because this NEW car
wasn't/isn't listed on the list of "approved 2009 plug in cars" by the IRS,
we seem to be left having to pay the back 2009 deduction.  UGH !!

I am fighting the same battle as you with IRS over my 2009 Prius purchased from Green Car Co with Hymotion A123 conversion.  Initially there has been confusion because IRS reviewer thought I was claiming the 2009 Prius on the expired hybrid credit.  I am waiting to hear from their decision on my resubmitted evidence and citing the pertinent law.

A123 Hymotion hasn't been much help.  They seem vague about the need for a Manufacturers certificate.  Despite this the tax credit is featured prominently in their ads.

I was just finished working my 2011 taxes for my DIY conversion and
didn't see anything on Form 8910 about required manufacturer certs for
conversion. Turbo tax made no mention of it either in the deduction
documentation they provided.

Anybody else have any problems or successes getting this credit?

Good News,
For all of you struggling with the IRS over the 2009 Federal IRS rebate for
plug-in cars:  We just received notice that our 2009 tax status will stay
put (they won't make us reimburse nearly $3,000 rebate when we bought the
Hymotion upgraded new 2009 Toyota Prius).  For any of you struggling with
the IRS over this thing, hopefully this will give you encouragement to
"stick with it".  All we did was persistently present our case that in fact
we DID meet the requirements they laid out (even if it was 2 manufacturers,
not 1, that put together our car).  Best wishes.
