defrauding Medicare over the relabelling of
Paxil (GSK), and now Aventis will have to
pay $95 million over the relabelling of
another drug.

In addition to these three crimes, Kaiser hid
the MMR vaccines damage for the CDC, and also had

I would like to see the legal argument where it
says CDC can lie to the US people on behalf of
Kaiser-Permenante.

Sanofi-Aventis Settles Medicaid Price Dispute

Sanofi-Aventis SA will pay $95.5 million to settle allegations that it
overcharged state Medicaid programs for anti-inflammatory nasal
sprays, the Justice Department announced Thursday.
The settlement resolves charges that between 1995 and 2000 Aventis
Pharmaceutical Inc. knowingly misreported its best drug prices to
Medicaid programs. Under U.S. law, drug makers are required to report
to the government the best prices for their drugs and give those rates
to Medicaid.
The Justice Department said Aventis manipulated its "best price"
numbers for the nasal sprays by entering into an agreement with the
HMO Kaiser Permanente that repackaged Aventis' drugs under a new
label.
The agreement allowed Aventis to avoid paying millions of dollars in
rebates to Medicaid programs, the department said.
"When a drug company agrees to be a provider to the Medicaid programs,
it agrees to sell its drugs to them at the same price it gives its
best customers," said Michael K. Loucks, the acting U.S. attorney in
Massachusetts who was involved in the Aventis investigation. "We will,
as here, pursue those who break their promises."
The U.S. unit of Sanofi-Aventis said in a statement that it believed
Aventis Pharmaceutical "acted in accordance with the law at the time,"
but said it chose to "resolve this legacy matter through this
settlement, without admitting any wrongdoing."
The drug maker said the full cost of the settlement would be covered
by existing reserves.
The nasal sprays at issue are Azmacort, Nasacort and Nasacort AQ.
