IMPORTANT: The focus is on actual symptoms and ability to
function.
Q 5 * But what about t-cell counts. If they are under 200, don't
I qualify for disability? No, not necessarily. The confusion
about t-cell (cd4) counts stems from the Center for Disease
Control definition of AIDS, which includes those with HIV
infection
Q 6 who have absolute cd4 counts below 200 (or below 14%). This
definition holds whether an individual is symptomatic or not,
and is for statistical reporting purposes. It does not
describe disability criteria set down by Social Security
Administration.
Q 7 *Suppose I am experiencing either a "stand alone illness" OR a
series of less severe chronic illnesses that impair my
functioning, I may not qualify for disability even if my
T-Cell count is below 200. Do I have to be on my death bed?
Q 8 No, if you are diagnosed with a stand-alone condition
(opportunistic infection or indicator disaease) such as PCP,
MAC, etc., you meet the criteria for Soc.Sec. Disability;
otherwise, your documented symptoms will determine your
eligibility.
Q 9 In other words, if you and your doctor agree that your ability
to do your regular work is impaired by your symptoms, Social
Security will sometimes award benefits regardless of whether
your T-Cell (CD4) count is greater OR less than 200.
Q 10 *I'm not ready to stop working completely but because of a
period of illness, I need time off. How sick do I have to be?
If your physician determines you are unable to do your usual
and customary work for 8 days or more, you will meet the
medical
Q 11 qualifications for State Disability Insurance (SDI). However,
for permanent disability, you must meet the criteria for
Social Security Disability Insurance which assumes you cannot
do ANY work for 5 months or more.
