with their finger rather than a stylus."

I'm assuming that the button size/location is a feature of the user
interface via the Windows Mobile API so is there any reason Garmin
couldn't retrofit that interface to the M3 and M5 units via a software
update?

hmm, Actually now that they've done it for one model some clever lawyer
might sue them if they *don't* retrofit the M3/M5 units if somebody
ever gets into an accident while using them ;)

Next thing you'll be suggesting people might successfully sue Nokia because
they crashed while sending an SMS on their cellphone while driving. Safety
while driving is totally the responsibility of the driver in charge of the
vehicle.

Well it's not like people could successfully sue a fast food chain like
say Macdonalds for not telling them explicitly that the coffee they
just ordered thru the drive thru was hot... oh wait they did!

I've been told that Cessena went bankrupt because of years of being
named as co-defendants in virtually every law suit after a small plane
crash.

I read a report once (possibly a re-telling of urban myth) that
Mercedes delayed the introduction of antilock brakes to the US market
because they were afraid that they'd be named in suits if somebody rear
ended an ABS equiped M-B with a car that didn't have ABS.
