to The Reserve at Packer Park
On behalf of The Reserve at Packer Park Homeowners’ Association, the
Board of Directors has been in contact with our local government
representatives regarding the continuing noise and vibration problem
that we are experiencing from Eastern Metal Recycling, LLC (formerly
SPC Corporation, a subsidiary of Camden Iron and Metal, Inc.).
Eastern Metal Recycling, LLC processes scrap metal and operates a
metal shredding and metal recycling facility located at the base of
the Platt Bridge on 2600 Penrose Avenue. The operation handles and
shreds all types of ferrous and non-ferrous scrap metals: automobiles,
trucks, appliances, machines, and scrap generated from industrial
production.
We all have experienced the disturbing noises and vibrations that are
being generated from this facility. On January 5, 2012 the day after
a night of several severe explosions, the Board contacted our State
Representative Maria Donatucci, our State Senator Larry Farnese, and
City Councilman at Large and Environmental Committee Chairman, James
Kenney. On February 9, 2012 the Board also contacted our newly
elected City Councilman Kenyatta Johnson (Mr. Johnson had not taken
office until January 26, 2012). In our correspondence, we informed
these representatives that we believe that these surprise explosions
may be prejudicial to our health and that the resulting vibrations may
be damaging to our homes. We informed them that we believe that
Eastern Metal Recycling continually violates Philadelphia Code,
Chapter 10-400, Noise and Excessive Vibration. As a result, we are
asking them to join us in requesting that Philadelphia Air Management
Services (AMS) conduct a formal investigation and possibly issue an
abatement notice to Eastern Metal until the issue is resolved.
On January 6, 2012 we were contacted by Representative Donatucci for
additional information. Specifically, she requested a log recording
the date and times of the explosions, and a list of our residents that
called AMS. Our Property Manager, Mr. Andrew Sytnik and one of our
residents, Mr. Andrew Rosser were instrumental in compiling the
documentation for Ms. Donatucci. On February 9, 2012 we submitted our
documentation to Ms. Donatucci. On February 10, 2012 Ms. Donatucci
contacted us to acknowledge receipt of the documentation. At that
time, we discussed the problem and requested that she research the
Philadelphia Regional Port Authority’s recent rescission of a grant to
establish a pier and relocation site for Eastern Metal in Eddystone,
PA. She informed us that she would also investigate any options the
state had to expedite Eastern Metal’s move.
Councilman Johnson recently contacted us as well. We informed Mr.
Johnson that our neighbors have been very persistent reporting these
incidents to AMS. We informed him that though AMS promises to inspect
and evaluate Eastern Metal, we are never informed of the results of
their inspections or evaluations, and the explosions continue. As a
result, Mr. Johnson advised us that he will work with AMS to obtain
and review their inspection and evaluation reports. He will try to
determine if the City has any options to take against Eastern Metal.
Mr. Johnson hopes to act as a mediator for us with AMS and Eastern
Metal in finding a solution to this problem as he has been in contact
with AMS and Eastern Metal’s attorney. He is also working with the
Fire Marshall regarding this issue.
Senator Farnese's office has also contacted us for our documentation
and informed us they will forward it to AMS. As of yet, Councilman
James Kenney has not contacted us.
Additionally, our Board has been in contact with representatives and
management for our neighbors at the Villas, Regency, and Siena Place.
We have advised these communities of our efforts and have provided
them with the contact information for AMS. We have also asked them to
catalog their residents’ efforts as well and forward them to our local
representatives. We are hopeful that we can soon to meet with
representatives from Eastern Metal, AMS, the local communities, and
our local government.
Though the explosions continue, please remain diligent in reporting
them to AMS. Please continue to document your calls to AMS and please
continue to report your calls to our property manager. It is a slow
and painful process, but the important thing is that this problem has
been brought to the attention of our local representatives and they
are eager to assist us.
