Art Garfunkel Charged With Having Pot

HURLEY, N.Y. - Art Garfunkel, part of the folk music duo Simon and
Garfunkel, was charged with marijuana possession after police pulled his
limousine over for speeding in upstate New York.

Garfunkel, 62, had a small amount of marijuana in his jacket pocket when
a state trooper stopped the limo Saturday afternoon in Hurley, 55 miles
southwest of Albany, the Daily Freeman of Kingston reported.

The trooper smelled marijuana after approaching the vehicle, in which
Garfunkel was the lone passenger.

Garfunkel, of Manhattan, was scheduled to appear in court on Jan. 28 on
the charge, which carries a possible $100 fine, or he could respond by
mail.

A representative for Legacy Recording, Garfunkel's New York-based record
label, did not immediately return a phone call Wednesday.

Garfunkel completed a U.S. concert tour with Paul Simon last fall, their
first in 20 years. The duo, who have been inducted into the Rock And
Roll Hall of Fame, produced a string of hits in the 1960s, including
"The Sounds of Silence," "Mrs. Robinson," "Old Friends" and "The 59th
Street Bridge Song (Feelin' Groovy)."

Ah yes, a nothing case, latched onto by the former journalism profession,
now a branch of the entertainment industry, "Quick, a celebrity got busted,

I thought NY had extremely harsh penalties for possession. ? This
sounds like OH law, which treats misdemeanor poss. fairly lightly.
Did Russell Simmons get Pataki to change it?

Nope.NY decriminalized marijuana about 25 yrs ago. 11 other states have also
decriminalized it... I think. Others would probably know the exact number of
states.

In NY it's simple posession if you have less than 25 grams (in one bag), which
gets you a civil citation and fine ($100 first offense, $200 second offense).
Obviously, you'd get charged with "intent to sell" if it is in separate bags
and/or if you, say, have a scale with you or a whole bunch of baggies, etc..

After the second offense, or if you get caught smoking in public, you get up to
15 days in jail, and up to a $250 fine.

The Rockefeller drug laws are mandatory minimum sentences regarding cases with
heroin and cocaine. They have nothin to do with NY's marijuana laws.

I saw that, but I didn't see anything about a driver being charged with
anything. Presumably the media is too dazzled with another celebrity in
trouble to worry about who was driving the car.
