I have got another question:
Is this violating intellectual property, or property right or, copyright?

Since that tune was written in the 1960s, you can bet someone owns the copyright. So, technically, unless you have permission from the copyright owner, you can't use that tune. But in reality, no one cares -- unless you strike it rich using that tune, in which case they'll come after you.

Why don't you use a classic cowboy tune that's in the public domain? "Streets of Laredo" is a fine tune, for example.

Here's Chet:

OK, so--(your expertise may be able to answer this--I'm sorry Tim Berens
no longer posts here)--Alan Sherman, who used "Streets of Laredo"--which
may have been PD at the time, but also used many songs still under
copyright--what is the situation in parodic use of a song?

I sure Sherman (or his publishers) paid whatever was due to the copyright owners of any works that weren't PD. Same goes for Weird Al or anyone else who makes good money doing that kind of work.

I don't think one has to contact individual copyright owners to pay up. This sort of thing is handled by centralized agencies like Harry Fox:

Everything I do is PD, so I've never looked into the nuts and bolts. Matanya knows this stuff through and through. If I had serious questions about this, I'd buy him lunch and pick his brain.
