Course, if it's done by private email, TSR has no way of every
knowing, and won't spend the money to prosecute if they do (since
we're talking private use here). But they'll never admit that.

If you get it from anyone but TSR themselves, or pass around a copy
yourself, it's copyright infringement.
To my knowledge, TSR hasn't made any of it's logo's available on the
Internet itself, though it's possible that some of them may be
available for download and private use from AOL. Still means you
can't legally have anyone but TSR send it to you...

Actually, the proper thing to do is to ask for permission to use
the image. And as the netrep, you're the one to ask about it (or at the
very least, you could direct him to the proper department). Don't just
tell him it's illegal to do it one way, tell him about the legal way to
do it as well.

We get this sort of request a lot, actually. Connie says this falls
under "personal use," so go ahead, use it for the tattoo ... and
thanks for the unspoken complement on the artwork. :)

Gosh, Sean, I just don't see how you can tell that this is a copyright
violation. It's this kind of chest thumping that goads me into telling
folks to ignore you. You should actually read the copyright law yourself
if you think it's impossible to copy your pictures without breaking
that law ... I'll give you a head start, check USC17, p113(c). I can't
tell is 113(c) applies here or not; how can you?

It's real simple, Ed. Do you own the original picture, or have it
commisisoned for you? Then you don't own the rights to the picture.
That's it, in the short form...

Actually, it's not that hard to tell, Ed - it's where he says:
"I'd appreciate it if someone could e-mail it to me...."
That, coupled with (on the TSR logo) "TM designates trademarks owned
by TSR, Inc. (C) 1994 TSR, Inc. All rights reserved."
However, this post was cleared up long ago once it was found that
he only wanted the logo for a tattoo, which falls under "personal use."

Here it is even shorter and even simpler: fair use. Now go read the
law and knock off this mind-reading routine. You have no clue a crime
is being committed just because he doesn't have "rights" to a picture.
USC Title 17 specifically and in no uncertain terms reserves certain
rights. Maybe all he wants to do is print the damn thing out and put
it on his AD&D notebook. That is 100% legal.
God, this junk gets worse every day. And over in the rec.arts.
