These two cases involve similar parties and issues. Pursuant to Federal
Rule of Civil Procedure 42(a), these two actions are consolidated for
all purposes. All subsequent filings are to bear the number
5:08-CV-169-C. Civil Action No. 5:09-CV-246-C is administratively closed.
