the ocean? I mean, Eric Holder already said "he's so obviously guilty" so
why have a trial?

maybe im off base - but i'm missing the point of why the outcome of the
trial
has any basis in the argument of whether the trial should be taking place in
the
first place.

yep, that's good thinking.

Why don't we come up with a list of all the people who have been charged
with a crime that we know are guilty, and we can save millions by not
having to have trials.

It might seem to some like we are regressing to the ways of the
Inquisition, but in reality it is a new way of thinking about concepts
such as due process and human rights. Brilliant!

Indeed. Another conservative who claims to want the federal government out
of the daily lives of everyday citizens, but also wants to give it the
absolute power to play cop, judge, jury and executioner.

So Obama can sling some more mud at President Bush and our CIA. In
addition, it will provide al Queada, Hezbollah, Hamas and the Taliban with
an international media platform and a better recruiting tool than they
could have ever dreamed of having without Obama's help. BTW, KSM already
plead guilty at a military hearing and was about to be tried by a military
tribunal that was authorized by Congress. The estimated cost of having
this totally unnecessary show trial in NYC is $75 million.

KSM already plead guilty at a military hearing and was set to be tried in
a military tribunal.
Obama had the trial moved to NYC so they can sling some more mud at
President Bush and our CIA, while diverting the public's attention away
from record deficits and 10.2% unemployment. BTW, this totally
unnecessary NYC show trial is estimated to cost tax payers $75 million.
On a brighter note, it will be an excellent recruiting tool for al Queada,
Hamas, Hezbollah and the Taliban.

I think Obama has firmly claimed the role of judge, jury and executioner.
In an interview yesterday he said the American people need not worry
because KSM will be convicted and have the death penalty applied to him.
Of course when the reporter called Obama out on this, Obama lied through
his teeth and said "I did not say 'when' I said 'if' ". Which was clearly
a lie because they had him on video tape saying it just a couple of
seconds prior to that. Hell they even showed Obama getting caught in that
lie on MSNBC. Point is, if Obama has already decided that the guy is
guilty and will get the death penalty, it makes his idiotic decision to
move the trial to NYC even more ridiculous. Obama claims that the reason
he is moving the trial to NYC is to show the world how fair our justice
system is. Well how fair is it when the President has already declared
that the guy is going to be found guilty and get the death penalty. This
whole political "show trial" by Obama is a fucking disgrace.

"Consistency" as you call it, is the hobgoblin of little minds. Ralph
Waldo Emerson.

In order to answer your question, you need to tell me which other
terrorist suspects have been shot by the United States while in custody.
That is the key difference between KSM and the terrorists who have been
killed as part of military operations in Afghanistan, Pakistan and Iraq.

KSM was captured alive in Pakistan. he was taken into custody. If you
believe the Bush Administration, the US got useful intelligence from him
during his interrogation.

Are you suggesting that we now shoot him and dump him in a ditch? If not,
then we need to put him on trial under US law. The only question was
whether to try him in civilian court or military court...either way he
would be facing a jury who could acquit him after hearing the evidence.
What you appear to be suggesting (killing him on the spot without a trial)
is not even something that right-wingers are publically advocating.

Has it ever? The system doesn't exist to enforce "rights" or "justice,"
it's there to reinforce the existing power structure. This isn't exactly a
new phenomenon, and it doesn't have anything to do with partisanship. If
you fail to grasp this, then you have a profound misunderstanding of how
this country's political system works.

The point is, the Bush administration treated the situation, rightly I
might add, as a military matter, not a criminal matter. Obama
deciding to treat KSM as a criminal is a mistake and calls into
question using the military in any way against terrorism.

That's the whole point. We shouldn't be hunting down and killing
people without benefit of trial. That is a war crime. You are only
allowed to do that against military forces of state with whom you are
at war. Surely you recognize that many innocent people get killed in
these attacks against terrorists, insurgents, whatever you want to
call them. The whole point is that the military becomes the judge,
jury, and executioner.

The Afghanistan/Pakistan War against Taliban/Al Qaeda is doomed to
failure. We should get the fuck out of their immediately, otherwise
we will wind up in the quagmire of fighting 40 million Pashtuns who
strongly support Taliban/Al Qaeda.

That would be what General McArthur advised against -- getting
involved in a land war in Asia.

Conventional military forces like the U.S. Army and U. S. Marine
Corps, as well as the IDF, are not well suited to dealing with
asymmetrical non-state actors like Hezbollah, Hamas, Taliban, and Al
Qaeda.

ESPECIALLY when the non-state actor has strong support from the local
population, as Hezbollah did in the Israel/Hezbollah War in Lebanon.
As soon as that conflict started, I immediately started posting that
Israel would not defeat Hezbollah, nor would they succeed in driving
Hezbollah back from the border a significant distance. For my 100%
accurate predictions, I was labelled an Israel hater. This is pretty
absurd, since I strongly support Israel. Friends tell other friends
when they are making mistakes.

Anyway, there is no doubt that both Taliban and Al Qaeda have strong
support from 40 million Pashtuns on both sides of the Afghanistan/
Pakistan border.

Even 500,000 troops could not win this war. It's unwinnable, and it
will suck trillions of dollars and thousands of lives from the USA
with no positive benefit in the end.

I beg to differ. This particualr trial have every thing to do with
partisanship. KSM has already plead guilty at a military hearing and was
set to be tried by a military tribunal. Obama made the decision to move
the trial to NYC for purely partisan, political reasons, His objective is
to put President Bush and the CIA on trial. Moving this trial to NYC is
unnecessary, will cost tax payers $75,000,000.00, will weaken our national
defense and will give muslim terrorists a tremendous propaganda and
recruiting tool.

Can you really be this stupid? Obama is giving muslim extremists a full
color, prime time, world wide news coverage propaganda and recruiting and
propaganda tool . For al Queada, Hamas, Hezbollah, Taliban and every

If he is an armed opponent taken into custody on a battlefield he would
have a defined set of rights and be subject to a military tribunal for a
defined set of crimes. KSM was arrested in an apartment in Pakistan with
the aid of Pakistani authorities nowhere near a battlefield.

Also, why, exactly, are you assuming he's guilty? Did you decide that
you've seen more than enough evidence on Fox News to convict him?

Well numb nuts, you don't know if there will be TV coverage in the court
or not. Regardless, it will be covered by national and international news
networks and every speech, comment and allegation that KSM or his lawyer
make will be beamed to every muslim country in the world. Not to mention
the national security information this civilian court may order turned
over to KSM and his lawyers. Obama could not have given al Queada a
better publicity, propaganda and recruiting tool.
