1099 REFORM UPDATE – ACTION SET BEGIN IN SENATE

Republican Senate aides confirmed this morning that the Minority
Conference has filed the 1099 repeal amendment to the FAA bill. The
proposal, authored by Sen. Mike Johanns (R-Neb.), had 15 Democratic
co- sponsors as of last Thursday and should have enough support to
overcome any attempt to filibuster it. Floor consideration of the FAA
bill is due to begin this afternoon. "A vote could come this week," a
senior Republican Senate aide said.

Background: Under current law businesses that spend a cumulative $600
or more with a vendor, supplier or contractor on services are required
to file a 1099 form with the IRS identifying the recipient of the
money. The 1099 issue refers to expanded information reporting mandate
contained in Section 9006 of the "Patient Protection and Affordable
Care Act" (PPACA). Under the expanded reporting provisions coin
currency and precious metals buyers and sellers across the nation will
be subjected to the data collection and information filing of IRS form
1099 on virtually all non credit card business-to-business and
business-to-person transactions they make aggregating $600 or more in
a year. Specifically, the provision would require any firm to file
with the IRS a 1099 form with each business or individual from which
it purchases more than $600 in goods or services. The new information
reporting requirement will not take effect in 2012 unless it is
repealed.

This 1099 is bullshit and is just another example of how Omammy want to
control our lives and particular coin sales. This is a pralude to the mark
of the beast for buying and selling. All of our rights come from two
sources, the holy bible and English Common Law. First most legal
definitions come from a book entitled "Block's Law Dictionary" Almost every
legal term we use today came from that book.
A goverment form need to be filled out only when permission is needed to do
something that is ordinarily illegal. So where in the U.S. Constitution did
the founding fathers state that buying and selling coins is illegal. Answer
they didn't. There fore, it always has been a legal to buy and sell with a
1099 form.

The forced use of 1099 forms to buy and sell, like Obama Care is
unconstitutional . Thank God the whole law just got thrown out by a judge.

You will see why O-Sambo's requirement to trace out gold coins via 1099
forms is being unconstitutional. The right to buy and sell is an
inalienable right. The term inalienable means our Rights come from God. As

The same applies with many other forms of paperwork used by the IRS. Only
import duties and non- apportioned taxes are valid under the constitution,
and only when payed with gold and silver coin. Both the income tax and the
Federal reserve are illegal scheams, because control of our money supply
turned over to Jewish internation bankers (Rothchilds and Bilderbergs) is
illegal. To Control is to ENSLAVE or erode ones freedoms. Another great
example is the Marriage License. Most are IGNORANT of the history behind the
marriage license and "legal" marriage. Legal Marriage came into effect here
in America just after the Civil War and the freeing of black slaves. Racist
whites during that time were afraid blacks would attempt to intermarry with
whites so they sought a way to CONTROL that situation and keep it from
happening,,,so they devised the Marriage License thus "Legal Marriage".
Prior to legal marriage was "Covenant Marriage" a RELIGIOUS INSTITUTION,
established, ordained and governed by God not the state. By licensing
marriage the government violates its own rules of separation of church and
state. Along with Legal Marriage came the corruption of marriage with such
corrupt laws as no fault diviorce, Corrupt family law courts and child
support programs, abortion, homosexual "marriage" etc etc . God is kicked
out of the goverment and the loss of His absolute moral compass in policies
are whats destroying our country today.

American citizens were prohibited from owning gold bullion and non-collector
item gold coins from 1933 to the mid-1970s, so once again you appear to be a
clueless, ignorant, bigoted buffoon.

Actually, President Obama mentioned this in the State of the Union address
when talking about the Health Care Refirm Bill. He said, "If you have ideas
about how to improve this law by making care better or more affordable, I am
eager to work with you. We can start right now by correcting a flaw in the
legislation that has placed an unnecessary bookkeeping burden on small
businesses."

So the President is on the side of eliminaing this provision. The ball is
in Congress' court.

Where do you get that secession is illegal? I take it you've never
read the Declaration of Independence!
What was established at Appomattox in 1865 is that there is a LEGAL
and CONSTITUTIONAL way to do it. A few states can't simply wander off
on their own. It takes ALL of them or at least perhaps 2/3 or 3/4 to
do it. And if they do that it is a LEGAL operation just like any
amendment to the constitution. And THEREFORE it clearly follows that
if ordered to occupy any state that has simply VOTED to secede a
soldier or other official MUST refuse that illegal order. And that
goes so long as legal procedures are carefully followed. The president
is not a king or dictator (even though many would sure like to be).

There is a lot of devil here in the details. In fact, in my humble
opinion what the United States needs is a complete secession of ALL
states with a provision at the same time to REFORM under the ORIGINAL
constitution and 13 amendments. [sorry, no slavery (13), but we DO
want to "question public debt" (prohibited under 14)] I believe our
original constitution has been far too subverted to be put back the
way it was any other way. Like a cancer, that room full of federal Law
books and that city full of criminals (DC) needs to cut out and tossed
into the biological trashcan.

AND just in case you are totally unaware of the world, let me note
that the Rockefeller establishment has been attempting to install a
new constitution (the nightmare "NewStates Constitution") just this
way for a great many years now. So far, all their attempts to create a
constitutional convention (con-con) have failed, but that clearly
shows they recognize the power and legality of the method. We the
people should recognize it too.

Why that was ever included in the bill is a mystery to me. I'd like to see
a show of hands among Congress to see which ones support it, especially the
one(s) who introduced it.

As for the bill itself, I still haven't heard about much there that would
actually make health care more affordable, as I notice my own monthly
premium increases once again this January. Although much of the important
stuff shouldn't really cost the government ANYTHING -- keeping kids on
until 26, no denying people with pre-existing conditions, no coverage
limits, etc., you can be sure that the increased cost burden on the
insurance companies will be passed on to us paying customers in higher
premiums.

Requiring everyone to purchase health insurance seems ridiculous when put
that way. If you don't comply, you face a fine? You refuse to pay the
fine, you face jail time? You do jail time, you get free health care on the
taxpayer, including everything from dental work to a sex change. Plus, if
you act quickly enough, you might be able to scam several other Federal
benefits while in the slammer before they close the loopholes.

If my fellow business owners didn't cheat so much, there would be no need to
expand 1009-Misc reporting. But they do cheat -- and as the Congressional
Budget Office reported, this provision will bring in $17 billion more.
That's a lot of cheating.

I gotta love the anti-regulation folk. Regulations exist because so many of
us in the private sector cheat, pure and simple. The deceptive practices
within the private sector are astounding and I am amazed that not only does
the public let us get away with it, but the Republicans who claim to be for
law and order seem to feel it's just fine for businesses to cheat on their
taxes and not honestly or accurately report their income.

Now if the private sector would just stop cheating on their taxes... well, I
can dream, can't I?

Late last year, efforts by Sens. Mike Johanns (R-Neb.) and Max Baucus
(D-Mont.) to repeal the provision came up short, and a Democratic-led
effort to include 1099 repeal in the tax-cut package was one of
several proposed add-ons nixed by Republicans during the lame-duck
session.

As I understand it, the requirement that insurance companies accept
applicants despite pre-existing conditions is related to the
requirement that everyone joins the health care pool. It allows the
insurance companies to have a reasonable chance at a predictable risk.

On the other hand, calling it all insurance seems odd. It seems more
like a way of managing payments for those who can't plan and save. It
has all of the admin. you'd expect and it appears that there will have
to be limits (eventually) on catastrophic coverage.

That does make sense. I guess it might apply if each company was
required to take on the exact same percentage of clients with pre-existing
conditions, which could only happen with some new controlling agency (perish
the thought) brokering an equitable distribution of the uninsured
already-riskies.

I still question whether this would reduce our health costs (insurance
premiums)-- the main hype and goal of the bill sponsors-- since it doesn't
address escalating cost of fixing people, considering all the new
"conditions" that seem to require specialized medical treatment each year
and the evolving high-tech solutions to previously untreatable maladies.
Only the ultra rich would have considered chancing a knee or hip replacement
20 years ago. Now just about any part of the inside or outside of one's
body can be replaced-- at a price. Cost of revolutionary new cancer
treatments are constantly growing. I can't see how any insurance company
could ever keep premium costs down while paying for these increasingly
expensive treatments.

It was undoubtedly put in the bill by one of the "committees" that
drafted the legislation ... no individual lawmaker's fingerprints
will be on that particular provision. Popular provisions have
numerous congresscritters claiming it was "their idea", while
unpopular provisions are orphans.

It's unfortunately typical of the gubbermint's "budgeting process".
They enact legislation that will "increase Program A by $xyz billyun
dollerz" and pay for it by "cutting Program B by $xyz billyun dollers".
Later, they repeal the cost-cutting provision, but leave the spending
provision in place. Check out how many times they "improved Medicare
costs" by cutting reimbursement to doctors and hospitals in one bill,
then later delayed/cancelled the cuts in another.

Looks like the 1099 reporting requirements have been repealed.

The new reporting requirement only applied to CORPORATIONS, but as
usual, hatred for Obama was leveraged for the Fox News/talk radio
crowd who was stirred up in protest to get the law repealed by being
told the law applied to THEM (Nancy Pelsoi wants to track all your
purchases and control your life! O-mammy wants to know when you buy a
gold coin -- or a gun!)

Too bad people like Nick Pyle, Barry Stuppler, the ANA and ICTA fell
for it.

So now corporations can continue to evade taxes -- but the law STILL
APPLIES to individuals - as it has since the Nixon years -- and the
little guy will continue to get a 1099 form for any income over $10

Frank you will never get it. The existing law applies to services and
would expand to include all non credit card purchases. You have
confused existing bullion sales reporting requirements established to
prevent money laundering with the proposed expansion. Suffice it to
say the Senate passed repeal last night 81-17. Thanks and praise to
all those of you who have taken the time to respond positively and
negatively to my best attempts to educate the coin community about
this measure. I especially appreciate the comments from the guy whose
expensive Houston CPA said this 1099 expansion wouldn't apply to coin
dealers buying from the public. I wouldn't hire that CPA to count my
fingers and I have all ten by the way. Thanks again to all the
hundreds of you who took time to contact the Senate about this - now
on to the House!

ICTA member, and company I managed for ten years was a founding member
of ICTA

I met with the tax information firm RIA (which the Edwards article
quoted) IN PERSON
since their offices are based here in Fort Worth just a couple of
miles from me. They told me
the 1099 claims you make were NONSENSE, put me in contact with the
Richard Sanford, the
IRS Southwest district public affairs director who confirmed it was
NONSENSE, and supplied me with
a pre-release page from their upcoming manual PROVING that items
bought and sold for inventory are
not a part of any 1099 changes, which I posted in several numismatic
forums.

But nothing seems to beat the truth better than "Rush Limbaugh said
it"

Article I, Sec. 8 of the Constitution lists the categories where Congress
can spend money. If a program is not there, no money can be spent. Period.
There is no category there for spending money on the enforcement of a health
care mandate. Thus, such a proposal is unConstitutional. Hall's article has
reminded me to, again, thank God that I never went to college!

If you want to talk about "mandates" -- When President Ronald Reagan
signed into law the Emergency Medical Treatment and Active Labor Act,
it was supposed to address the problem of “patient dumping” by
hospital emergency departments.

Violation of EMTALA could result in fines of up to $50,000 per
violation to both the hospital and the physician and loss of Medicare
reimbursement. EMTALA provided a classic lesson of what happens when a
business activity, which provides a product or service at a price, is
compelled by government to give its product away free. When it
happens, everyone loses. Both the producer and the buyer lose to those
who “take,” protected by the power of the federal government.

Since 1986, EMTALA has grown and spread, unstoppable, like a plague
pandemic. Because of increased “regulatory guidance” and judicial
action, EMTALA mandates now cover virtually every area of a hospital
and its satellites. It was not long before it began strangling the
health care system and our medical providers.

The EMTALA grew to mean that anyone who enters with an ‘emergency,’
now defined as including: cough, headache, hangnail, cardiac arrest,
herniated lumbar disc, drug addiction, alcohol overdose, gunshot
wound, automobile trauma, human immunodeficiency virus (HIV)-positive
infection, mental problem, or personality disorder, must be treated.
Any patient coming to a hospital requesting ‘emergency’ care must be
screened and treated until ready for discharge, or stabilized for
transfer – whether or not insured, ‘documented,’ or able to pay. A
woman in labor must remain to deliver her child.

The impact of EMTALA on medical care in America was dramatic. Between
1993 and 2003, 60 California hospitals closed because over half the
cost of services they provided could not be collected. Three years
later, another 24 California hospitals verge on closure for the same
reason. In Arizona, 38 medical centers reported losses of $153 million
because of foreign nationals who had to be treated free under EMTALA.
Now, three years later, many of those hospitals have closed or further
reduced services.

Ambulances from Mexico came to American hospitals with indigents
because the drivers know that EMTALA requires the hospital accept
patients who show up on the doorstep. Within a decade we saw reduced
availability of medical care because of the burdens imposed by EMTALA
and immigrants on health care systems. In smaller towns, such as
Bisbee, Arizona, they were forced to reduce their operating expenses
to pay for the free medical care they were compelled to provide. They
fired 35 of their 130 employees and eliminated services, such as a
maternity ward, to continue to meet the federal dictate to provide
free care to those who cannot pay for it.

In Tucson, which provides the only trauma center near the border, the
hospital there wrote off $12 million for unreimbursed medical care
year after year. Four hospitals closed in the San Diego area,
(Calexico Hospital, Harbor View Medical Center, Kaiser El Cajon and
Scripps Memorial Hospital East County), making Southern California the
region with the greatest number of closures, at 15 hospitals, or 65
percent, of closures largely due to losses because of unreimbursable
medical costs provided to illegal immigrants.

Under EMTALA, the choice is either treating the indigent for whatever
reason they demand care, or getting slammed hard with Federal fines
and lawsuits.

Obama have no right to track our buy and sell with 1099 forms. We do not
need goverment paper work, it just make people cheat on their taxes more,
due care, thats it, don't fraud, hurt, or damage peoples property. nothin
more nothin less, pay your fare share nothing more nothi9ing less but people
dont want to have a paper trail reporting and tatteling on them, that just
make it worse, people yell about their rights all of the time, and 90
percent have no idea what these rights are, your rights are the organic laws
of God, the land, bill of rights, treaties, declarations. anything other
than that is corporate policy ie statutes, codes, ordanances which are all
contract law, which has nothing to do with the people that are not in these
contracts. tell me what qualifies someone to trade a coin for cash, it is
worth the ame so its even trade, not anything to report or declare, policy
enforcers (like police man) do not know or understand law, i know cause i
have alot of them as friends and drill them constantly on law, subject
matter, jurisdiction etc. none of them so far can tell me the different
types of law, de jure, defacto, contract, organic or anything else, i'mma
post the definitions of buyer, seller, third party, etc you tell me if this
applies to you

BTW, I do notice you're down to $750 now. I still submit that very few
shoppers go into Wal-Mart with the intent of spending $1,000. Quite a few
more at Lowe's perhaps, considering the extent of expensive stuff they
offer.
