ROCHESTER - A Pennsylvania man accused of
selling gold coins to a Lilac City resident
on eBay for more than $2,000 but then never
delivering them upon receiving payment is
facing felony theft charges.
Robert Didomenico, 30, of 115 South
Franklin St. in Fleetwood, Pa., was indicted
recently by a Strafford County grand jury
on a charge of theft by deception for
allegedly selling the coins on eBay with
no intention of delivering them.
According to court documents, on or about
Dec. 3, 2007, Didomenico offered the coins
on the online auction and shopping website
and a Rochester man purchased them for
$2,314. The indictment states Didomenico
"had no intention of delivering the coins."
Theft by deception is a Class A felony
punishable by 71?2 to 15 years in state
prison.
An indictment is not an indication of
guilt; rather, it means a grand jury has
found sufficient evidence to warrant a
trial.
..
So if he's convicted, what are the odds that e-Bay will consider that
to be sufficient evidence to bar him from selling?
Slim, infinitesimal, or none?
That would depend upon him being a power seller or not. :-) Billy
